Monday 8 o'clock P.M. Kingston May 14th 1894

A meeting of the Council of the Corporation of the City of Kingston was held this day. Present

His Worship the Mayor

Aldermen

Allen, Behan, Carson, Curtis, Elliott, Horn, Martin, Meek, Mundell, McIntyre, McKelvey, Richardson, G. Robinson, Ryan, Skinner, Walkem, Wright

The clerk read the minutes of the two last meetings.

Communications summarized were read as follows: -

From T. O. Robson, President Re Canadian Cattle Trade - Referred to the Finance Committee.

From Miss Machar - Secretary poor relief Association showing expenditure for year - Referred to the Finance Committee.

From E. J. B. Pense asking for cheque Hospital Grant by city.

On motion of Ald McKelvey seconded by Ald Richardson Ordered, that the amount of $750 as provided in the Budget be paid to the Treasurer of the Kingston General Hospital.

From Robert Creighton Accountant Provincial Penitentiary enclosing account for material &c - Referred to the Board of Works.

From John Macdonald Secretary Public School Board asking on what terms the Board can aquire the use of Ontario Hall - Referred to the Committee on City Property.

From John Macdonald Secretary Public School Board asking for a Grant of $20,000 to erect a new School house and to pay indebtedness on Victoria School, about $1100 - Referred to the Committee on Finance

From W. M. Drennan, Secretary Celebration Committee Queens Birthday asking for a grant of $20 towards advertizing.

On motion of Ald McKelvey seconded by Ald. Meek Ordered That the communication of Wm M. Drennan on behalf of the Celebration Committee be referred to the Committee on Printing with power to act.

From George Osborne complaining of Horses and Cows being allowed to run at large.

On motion of Ald McIntyre seconded by Ald Martin Ordered That the communication of George Osborne be referred to the Committee on City Property and that in view of the number of complaints made by Citizens of the inefficiency of the present Pound Keeper the said committee is hereby ordered to make inquiry as to the cause of such inefficiency and report at the next regular meeting of this Council upon the measures proper to be taken to ensure a thorough enforcement of the pound By Law and the efficient protection of citizens in future from the annoyance complained of.

Petitions were presented and referred as follows: -

From Miles Sinnott and 14 other Cabmen by Ald Behan asking for a reduction of License - Referred to the Committee of Finance.

From George Cliff, by Ald Horn, respecting frontage charges - Referred to the Board of Works.

From W. Smallridge and 9 others by Ald Mundell asking for removal of Board Walk to East side of Alfred Street between Union and Earl streets - Referred to the Board of Works.

From Wm [William] J. Baker and 5 others by Ald Carson asking to have Barrie Street watered between Queen and Colborne Streets - Referred to the Board of Works.

On Motion of Ald McKelvey seconded by Ald Meek.

Ordered That the resolution passed by this council on April 30th last instructing the Solicitor to appeal the suit, City of Kingston vs The Kingston Portsmouth and Cataraqui Railway be [stikethrough] reinstated [/strikethrough] reconsidered.

On Motion of Ald. McKelvey seconded by Ald Meek.

Ordered That the Solicitor be instructed to stay all proceeding in connection with the suit of Kingston vs Kingston, Portsmouth and Cataraqui Railway.

On Motion of Ald Carson seconded by Ald McIntyre.

Ordered That the report No 2 1183 1/2 of the Board of Works dated May 7th 1894 be adopted and an agreement between the company and the City in the matter be entered into and the agreement of the 9th May 1893 to apply also and that until the agreement be adopted and extended no work be done on the new track - Provided that before the final adoption and execution of the agreement the owners of the several properties abutting upon the North Side of Princess Street from Alfred Street to the Western limits of the City be notified in writing of the proposal to lay the track on the North side of the street and they be given an opportunity of laying their objections to such proposal before this Council.

On Motion of Ald Behan seconded by Ald Allen.

Ordered That the sum of twelve dollars be advanced to the four Firemen for the purchase of New Uniforms and that the same be charged against, their increased salary.

Ald Meek introduced consolidated By Law No 494 entitled "A By Law for licensing and regulating milk vendors within the City of Kingston and fixing the fees to be paid for such" which was reach a first time -

The 30th Rule was suspended and the Council went into Committee of the whole on the second reading.

Ald G. Robinson in the Chair.

The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause the report was received.

The 30 Rule was again suspended, and the By Law was read a third time and passed.

Ald Meek introduced Consolidated By Law No 493 entitled "A By Law to encourage the planting of Trees for shade and ornament on certain of the public Streets, Highways, Squares and public places of the City of Kingston" which was read a first time -

The 30th Rule was suspended and the Council went into Committee of the whole on the second reading.

Ald Ryan in the Chair.

The Council resumed.

The Committee rose and the Chairman reported the Second reading of the by law clause by clause the report was received.

The 30th Rule was again suspended and the By Law was read a third time and passed.

Ald McIntyre from the Committee on Finance and accounts brought up Reports (numbers 1182 and 1183 Book G) which were read and adopted.

The Chairman from the Board of Works brought up a Report (Number 1184 Book G) which was read and adopted

The Chairman from the Committee on Water Works brought up a Report (number 1185 Book G) which was read.

Ald Elliott moves seconded by Ald Walkem.

That the report of the Committee on Water Works be received and adopted.

In Amendment 1st

Ald Horn moves seconded by Ald G Robinson.

That the amount of the account I.E. $50 of Collins Bay Rafting Company be paid.

In Amendment 2nd

Ald McKelvey moves seconded by Ald McIntyre.

That the sum of $50 as charged by the Collins Bay Rafting Company for the removal of the Rouseau pipe be paid said amount to be afterwards collected from the owners of said pipe as we may be advised by the City Solicitor - which being put was lost and the first amendment being put was carried.

Yeas: The Mayor, Aldn Allen, Behan, Carson, Curtis, Horn, Mundell, McIntyre, McKelvey, G Robinson, Skinner Walkem - 12.

Nays: Aldn Elliott, Martin, Meek, Richardson, Ryan - 5.

On Motion of Ald Mundell seconded by Ald Walkem.

Ordered That the report of the Committee on Water Works be received and adopted as amended.

The Chairman from the Court of Revision brought up a Report (number 1186 Book G) which was read and adopted.

The Chairman from the Committee on Fire, Water and Light brought up a Report (number 1187 Book G) which was read and adopted.

The Chairman from the Committee on Parks brought up Report (number 1188 Book G) which was read and adopted.

On Motion of Ald Curtis seconded by Ald Carson.

Ordered That the Police Commissioners be requested to swear in William Phillips as a constable for special duty in connection with the City Parks.

Ald Carson introduced a By Law to authorize the construction of a common sewer in a part of Balaclava Street in the City of Kingston as a local improvement under the provisions of the Municipal Act on that behalf which was read a first time.

The 30th Rule was suspended and the Council went into Committee of the whole on the second reading

Ald Walkem in the Chair.

The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - The Report was recieved.

The 30th Rule was again suspended and the By Law was read a third time and passed.

On motion the Council adjourned.

A Meeting of the Council of the Corporation of the City of Kingston was held this day. Present

His Worship the Mayor Aldermen Allen, Carnovsky, Carson, Clements, Drennan, Dupuis, Harty, Metcalfe, McCammon, McIntyre, McKelvey, McRossie, Pense, Powers, Tandy, Thibodo, White

The Clerk read the minutes of the last meeting

The Mayor submitted to the Council a Patent purporting to be Ordnance Land Sale Grant to "the Corporation of the City of Kingston" a parcel of land of the property known as the "Herchmer Farm" situate[d] in the City of Kingston, to be used as a Public Park (dated January 19 1876)

A Communication from James Agnew Esquire City Solicitor was read In Re Adair vs Kingston and Montreal street.

A Communication from Mrs Jane Garret, Sharbott Lake was read asking payment of Ten dollars for bed clothes destroyed sent with man taken with Small Pix and sent to Kingston Hospital.

On motion of Ald: Drennan seconded by Ald: Price Ordered, that the communication of Jane Garret be handed to the County Clerk and that the City Clerk notify her to that effect.

The Mayor mentioned that he had been served to-day with an appointment for the 26th instant for proceeding with the arbitration between the City and County in reference to the Court House

A Communication from E.J.B. Pense Esquire was read asking the Council to relieve the British Whig of its Contract for Printing.

On motion of Ald: Drennan seconded by Ald: Harty Ordered, That the Communication of E.J.B. Pense in regard to agreement for Contract for Printing with the City and that said Pense be relieved of said Contract

A Communication from Messrs Kirkpatrick and Rogers. In Re Canadian Engine & Machinery Company Taxes was read

On motion of Ald: McIntyre seconded by Ald: Price Ordered, That the Communication of Messrs Kirkpatrick and Rogers be referred to the Court of Revision to report

A Communication from the Department of the Interior was read enclosing Letters Patent in favor of the Corporation of the City of Kingston for a Park

their services in reporting the proceedings of this Council during the present year.

A Communication from S.L. Morrison Esquire was read requesting that the guage of the street Railway to be laid in this City be changed from three and one half feet to four feet.

On motion of Alderman Drennan seconded by Ald: Allen Resolved, that in the opinion of this Council the street Railway By Law should be Amended by extending the width of track of said Railway to four feet.

Ald: Drennan introduced a By Law respecting the Kingston street Railway which was read a first time.

On motion of Ald: Dupuis seconded by Ald: Price Resolved, that in the opinion of this Council arrangements should be made for having the minutes of the proceedings of the City Council together with a detailed account of the moneys received and expended in this City, printed in pamphlet form for gratuitius distribution among the taxpayers of the City, and that the Committee on Printing inquire and report upon the expense of so doing.

On motion of Ald: McCammon seconded by Ald: Harty Ordered, that the next regular meeting of this Council be held on Tuesday January 2nd 1877.

On motion the Council adjourned.

The meeting adjourned for want of a quorum.
