Witnesseth. That Whereas on the 31st day of August A.D. 1905 Lease Contract between Northern Texas Traction Co. and S. L. Mayers. Now Therefore in consideration of the premises and of the payment of $1.00 to the N. T. T. Co. and other valuable considerations the receipt of which is here by acknowledged that said N. T. T. Co. does hereby lease to said second party his heirs and assigns the right to construct and maintain a concrete or cement side walk with curbing and also to plant grass and trees upon such portion of the hereinafter described land as shall be designated by the Management of N. T. T. Co. the said triangular piece of ground being described as follows: Beginning at a point in the east line of said lot 15 feet north of the south east corner

of said same, thence north 35 feet to the Northeast corner of said lot. Thence west on the north line of said lot 47 feet to a stake. Thence in a south easterly direction across said lot to said point of beinning in the east line of same.

It is understood and agreed however that should the Northern Texas Traction Co. party of the first part ever desire to use a portion of said triangular piece of ground upon which said side walk and curbing may have been constructed and the said trees and grass planted the second party for himself and his heirs and assigns agrees to remove the said side walk, curbing trees and grass within ten days notice from the said Northern Traction Co. to do so and should the said second party his heirs or assigns fail to remove said sidewalk, curbing trees and grass within the time specified the said Northern Texas Traction Co. shall have the right to at once

remove said side walk, curbing trees and grass or anything else that may have been constructed upon said ground by the said second party, his heirs etc.

It is further understood and agreed that the said second party will and hereby agrees to hold the Northern Texas Traction as harmless from and and all claims for damages that may have be made by either the public or by any person or Corporation including the City of Fort Worth, which may arrise by reason of the construction and maintenance of said side walk, curbing and the planting of said trees and grass or other improvements upon said piece of ground.

It is further understood and agreed that the said Northern Texas Traction Co. reserves the right to terminate this lease Contract at any time after ten days notice to the said second party his heirs and assigns for any reason whatsoever and as the said first party its successors and assign may desire
