TO THE HONORABLE CITY COUNCIL OF THE CITY OF FT. WORTH:

The undersigned petitioners would respectfully show that Ordinances Nos.___ and___, now in force in the city of Ft. Worth, prohibiting the suspension of signs etc. over the streets and sidewalks of the city, works an unnecessary hardship upon persons engaged in the jewelry and watchmaking business as well, as an inconvenience to the public; and they respectfully ask that said ordinances be so amended and modified as to permit them to suspend what is known as the "Watch" sign over the outer edges or sides of the streets under such regulations as will reasonably protect the public from danger and indemnify the city in case of accident and injury on account of same.

To John T. Montgomery Sec. City of Ft Worth Texas

You are hereby informed, That I am the owner of the East 1/2 of the South 1/2 of Lot No. 1 of Smith's West Side addition to the City of Fort Worth, Texas.

That said Lot fromts 50 feet on Weatherford St. and 100 feet on Royal Ave. being the South East Cor. of said Blk. No. 1, Smith's West Side addition to the City of Fort Worth, Texas.

That the City of Fort Worth has and maintains a water hydrant for the extinguishing of fires, located on the side walk on the North West Cor. of Royal Ave. and Weatherford St. immediately in front of petitioners property.

That this hydrant is so defective and out of repair that there is a constant flow of water from same, which collects in the gutter and overflows the side walk in front of petitioner's property, frequently flooding petitions yard, creating a constant nuisance in front of and upon petitioner's premises, which greatly annoys petitioner and his family in the enjoyment of his property, in this, that it is impossible to approach his premises from the fromt with a vehicle of any kind without getting your clothing and horse and vehicle spattered with mud and water.

That the water from this hydrant as aforesaid collects in the gutter in front of petitioner's property, and in warm weather becomes polutted from the accumulated soil, which creates noisome and foul orders, which greatly annoy petitioner and his family in the enjoyment of his property.

That the said City has greatly aggravated said nuisance by its contract with the Fort Worth Street Sprinkling Company, whereby it has licensed said Sprinkling Company to draw water from said hydrant.

That said Sprinkling Company with its heavy wagons, keeps the street cut up in front of petitioner's premises and the parties drawing water from said hydrant are guilty of gross negligence in that they do not shut off the water from the said hydrant after they have filled their wagons but leave the same flowing.

That this nuisance is a continuous one and has existed for more than

two years.

That petitioner has time and again called the attention of the water Works department to this nuisance and asked that this Hydrant be repaired so as to abate the nuisance, but nothing has been done.

That said nuisance as it now exists has damaged petitioner's property in the sum of $2000.00 for which he shall ask redress, of the Courts, unless the same is at once abated.
