To the City Council, Fort Worth, Texas:

Your petitioners, A. L. Matlock, Geo. E. Miller and F. E. Dycus, composing the firm of Matlock, Miller & Dycus, respectfully represent that the City of Fort Worth has a claim for taxes and costs against them for the years 1902 and 1903, amounting to the sum of $34.12, which has been placed into the hands of A. B. Curtis, the Assistant City Attorney, for collection.

It appears from the records in the City Tax Collector's Office that this claim is for the personal taxes of the firm of Matlock, Miller & Dycus and that the amount of taxes and costs claimed is as follows:

For the year 1902, $12.07,

For the year 1903, 22.05.

By reference to the books of the City Assessor, it will appear that this is a claim for taxes due from the firm of Matlock, Miller & Dycus on their law library and office furniture for those years.

Your petitioners represent that a mistake in said renditions was made by someone for the year 1902. For the year 1902 the library and furniture of the firm was valued at $1500 and each member of the firm rendered his interest in the same at $500 and paid the taxes when due. The assessor's rolls show also that A. L. Matlock rendered the property for the firm at $500. This was a mistake, made either by the said A. L. Matlock or the assessor, and if we are required to pay the $12.07 taxes and costs for the year 1902, we would be paying taxes twice on the same property for the same year.

For the year 1903 it appears from the tax rolls that the library and furniture of the firm were rendered by F. E. Dycus at $1000, while for the same year A. L. Matlock rendered his part of said property at $500. A. L. Matlock paid the assessment rendered against him, but the assessment against the firm for $1000 was not paid.

It has been our custom to value the library and office furniture at the sum of $1500, which is the only property the firm has ever had subject to taxation in this county, and in all previous years to 1902 and 1903 and all succeeding years we have rendered it

separately, that is to say, we have each rendered and paid on $500 each

The only taxes now justly due against any of the members of the firm is for the rendition made for 1903 by F.E.Dycus for $1000 as it is not shown that either F.E.Dycus or Geo. E.Miller paid any taxes for that year on the library and furniture. The said A.L.Matlock paid on the valuation of $500 on said property.

Wherefore, your petitioners request that they be relieved of the payment of taxes and costs for the year 1902 and that they only be required to pay the taxes due and reasonable costs for the year 1903.

Respectfully submitted Matlock Miller D. Dycus Petitioners
