To the Honorable Mayor and city council,

Gentlemen:

I have the abstract with reference to the Jennie O. Johnson matter re-referred to me by you, and attach herewith a map for explanation thereof with the understanding that the said map after consideration by you is to be withdrawn by Judge R. G. Johnson, attorney for Mrs. Jennie O. Johnson.

I find on examination of the abstract and of the said map that the land indicated on the map by the letters in pencil made by me as follows to-wit, A, b, c , d, e and back to a, is the tract of land acquired by Mrs. Jennie O. Johnson.

The land indicated by the following letters in pencil made by me, a, b, c, g, f and back to a, in substance represents the land as now held by her and not taken by the city.

It appears that the question arising in this matter in all probability grows out of the location of what is known as the Valley Road. I have no personal knowledge as to the location of the Valley Road and accept the survey made by Henry Dickson as truly and correctly representing the location of the Valley Road in 1885. If his location of the road is correct, and I have to assume this and it is a matter for you to say whether or not my assumption is correct, unquestionably the city has taken some of Mrs. Johnson's ground.

On talking with Judge Johnson, the attorney for Mrs. Johnson, I find that the streets as actually laid and used on the ground differ somewhat from those shown on the map, and he states to me that his purpose is if he arrives at a compromise with the city to have his client deed the city the streets as they are laid on the ground at this time.

I would advise that if in your opinion you think a compromise should be arrived at, that it would be well to have the streets definitely located in the most convenient manner, which I believe to be as the said

streets are now laid on the ground and to have the conveyance made to cover the said streets as they are now laid on the ground.

In rendering this opinion I would state that I have not examined for taxes and things of that sort, as I do not regard them to be material to the point at issue.

Very respectfully,

E.C. Orrick City Atty

To the Honorable Mayor and City Council of the city of Fort Worth.

Gentlemen:

In the matter of the attached petition of Mrs. Jennie O. Johnson referred to me for report as to the ownership of the property claimed by her, I would state that I have consulted with Judge Johnson, her attorney, and he represents to me that she is the other of the same without any question. In the absence of an examination of the abstract, I would be disposed to take Judge Johnson's word as I have respect for his honesty in his statements and his legal ability in passing upon the question of title.

If, however, you desire an examination of the abstract to be carefully made, I will call on them for an abstract and will examine same and report further to your honorable body.

Very Respectfully,

EC Orrick City Atty
