Monday 7:30 OClock P.M. Kingston January 8 1877

A Special Meeting of the Council of the Corporation of the City of Kingston was held this day. Present

His Worship the Mayor

Aldermen

Allen, Carson, Clements, Drennan, Dupuis, Gaskin, McCammon, McIntyre, McKelvey, McRossie, Noble, Powers, Price, Tandy, White

The Clerk read the minutes of the two last meetings.

The Mayor stated he received the award of the Arbitrators in the erection of Court House which he submitted.

A Certificate from Michael Flanagan, City Clerk was read in Re votes in the Power Dry Dock By Law

A Circular from John Hallam Esquire Chairman of Committee Toronto was read enclosing report of Special Committee on taxation exemptions.

A Communication from C.V. Price Esquire was read stating the Directors of the Kingston Street Railway will not press any change of width of track at present.

A Communication from James Agnew Esquire, City Solicitor was read in re Adair verdict sustained.

A Communication from John Creighton Esquire was read in Re Arbitration Court House between County and City.

Petitions from John McMahon, W.B. and S. Anglin and John Holmes respecting Taxes and referred to the Court of Revision.

Ald: Gaskin brought up the petition of [strikethrough] Mary Dandy [/strikethrough] William McCartney praying permission to lay down building materials on Gordon Street Victoria Ward.

On motion of Ald: Gaskin seconded by Ald McKelvey Ordered, That the petition of William McCartney be granted on the usual Conditions

Ald: Allen brought up the petition of Mary Dandy praying for a remission of fine

On motion of Ald Allen seconded by Ald: Drennan Ordered, that the petition of Mary Dandy be referred to His Worship the Mayor with power to act.

Ald: McRossie from the Committee on Finance and Accounts brought up [strikethrough]a[/strikethrough] two Reports (Numbers 535 & 536 Book D) which [strikethrough]was[/strikthrough] were read and adopted.

The Chairman from the Committee on Fire, Water And Gas brought up a Report (Number 537 Book D) which was read.

Ald: Tandy moves seconded by Ald: McCammon That the report of the Committee on Fire, Water and Gas be received and adopted.

be appointed by the Mayor as a Civic Holiday and that His Worship be requested to issue the usual proclamation to that effect.

Ald Allen brought up the petition of Peter Henderson respecting taxes.

On motion of Ald Allen seconded by Ald Anglin Ordered, That the petition of Peter Henderson be referred to the Finance Committee.

A Communication from Alexander Smyth Clerk of the Market was read respecting the rent due by the Butchers occupying stalls in City Buildings.

On motion of Ald McCammon seconded by Ald Pense Ordered, That the Communication of the Clerk of the Market be referred to the Committee on City Property.

Ald Pense from the Committee on Finance and Accounts brought up a Report (Number 642 Book D No 2) which was read and adopted.

Ald Walkem from the Committee on City Property brought up a Report (Number 643 Book D No 2) which was read.

On motion of Ald Walkem seconded by Ald Clements on City Property be received and adopted with the exception that the tenders be not accepted or the work proceeded with until the tenders are reported to the Council Yeas 11 Nays 7.

On motion the Council adjourned.

economical administration of the affairs of the City and for such purpose to place itself in communication with the different standing committees of the council with the Police Comissioners and the School Board

On motion of Ald Snook seconded by Ald Redden Ordered that Aldermen Gaskin, McIntyre Fee, McGuire and the mover be a Committee on officers and salaries and back taxes with power to examine books and documents and report in haste as expedient - yeas - 18 nays - 2

On motion of Ald Mooers seconded by Ald Irving Ordered that Alderman McKelvey be the Director of the Kingston and Pembroke Railway Company on behalf of the City during the ensuing year

Ald Carson moves seconded by Ald McKelvey That the Clerk advertise in both Daily Papers two insertions for applications up to Monday next, noon to fill the office of assessors and that they be appointed at a future meeting of the Council and that the vote be taken by ballot and that the applications be in the hand [regarding] of the applicants.

In Amendment Ald Gaskin moves seconded by Ald Anglin That the vote for assessors be an open vote which being put was carried ^yeas 10 nays 9 and the original motion being put was carried as amended

On motion the Council adjourned

Ald McKelvey brought up the petition of George A Kirkpatrick and 900 others with reference to the By Law relating to Butchers which recently came into operation in the City and suggesting the desirability of petitioning the Legislative Assembly of Ontario to enable Municipalities to enact a fee from Butchers for selling in localities beyond the Market proper

On motion of Ald McKelvey seconded by Ald Carson Ordered that the petition of G A Kirkpatrick and others be referred to a Special Committee to consist of the following members: His Worship the Mayor, Aldermen Pense, Irving, Snook, Anglin, Fee and the mover - said Committee to Communicate with the Ontario Government with a view to having an act passed allowing Municipalities to charge Butchers a License and if they deem it advisable, two or more of the Committee shall proceed to Toronto at their own expense to obtain the views of the Government regarding the matter.

Ald McKelvey brought up the petition of John McMillan praying exemption from local taxation on the property known as Merlins Brewery & Distillery as it is his intention to put up a high grade flour Mill and Starch factory

On motion of Ald McKelvey seconded by Ald Mooer Ordered that the petition of John McMillan be referred to the Finance Committee to report.

Ald McGuire brought up the petition of Patrick Fallon praying the Council to purchase his broken stones at a fair price

On motion of Ald McGuire seconded by Ald McCammon Ordered that the petition of Patrick Fallon be referred to the committee on Streets

Ald McKelvey from the Committe on Finance and Accounts brought up a Report (Number 673 Book D Number 2) which was read and adopted

The Chairman from the Committee on Streets and Improvments brought up a Report (Number 674 Book D Number 2) which was read and adopted.

Ald McKelvey introduced a By Law to amend the By Law entitled "A By Law to amend the By Law passed on the seventh day of September 1840 relating to theatres

Ald Gaskin moves seconded by Ald Fee That the assesors now about to be appointed receive the sum of two hundred dollars each for all work required of them during their term

In Amendment 1st Ald Pense moves seconded by Ald Redden that the salary of the assesors be $220 each

In amendment 2nd Ald Drennan moves seconded by Ald Anglin That the sum of Two hundred and fifty dollars be the salary of the assessors for the present year - which being put was lost

Yeas - Messrs Anglin and Drennan 2 Nays - Messrs Allen, Carson, Fee, Gaskin, Gildersleeve Irving, Mooers, McCammon, McDermott, McGuire, McIntyre, McKelvey, McRossie, Oliver, Pense Redden, Snook, Wilson 18

The first amendment being put was carried

That all former questions in reference to assessors be reconsidered and that this Council proceed to elect two assessors for 1879 at a salary of $300 each _ which being put was lost

On motion of Ald McKelvey seconded by Ald McRossie Ordered, that we now proceed to elect three assessors-

On a vote being taken it stood as follows - McMahon 3, Nelligan 12, Gordon 15. Bartow 10, George 1 Miller 4, Tossell 9, Brown 4, Wrenshall 1, Gray 3

The Mayor declared, William L Gordon and Bartholomew Nelligan elected assessors

On a second vote being taken it stood as follows :_ Bastows
