To the Honorable Mayor and City Council, Fort Worth, Texas.

We, the undersigned, Real Estate owners in Block No. J and K of Fields Hillside Addition of Fort Worth, Texas, hereby agree to have sewerage connections made on our property in said block, and beg to petition your Honorably Body, and beg to petition your Honorable Body to require all real estate owners in said blocks to make proper sewerage connections with all present and future improvements.

To the Honorable Mayor and City Council of the City of Fort Worth.

Gentlemen:

I have the honor to report to you that I have tried in the County Court the two cases of Thielman vs City of Fort Worth, involving the pound law.

In one of the cases the value of the property was $40. In the other case there was a question as to whether the property was of the value of $15 or $20. The court held in the second case that the property was only of the value of less than $20, and that therefore an appeal from the Justice Court would not lie.

In the case where the property of the value of $40 was involved, the court held in favor of the city and of the pound master. I therefore report that it will be necessary for the city to pay the costs in the smaller case, and that it will devolve upon the plaintiff, Thielman, to pay the costs in the other case.

This presents a most peculiar situation for the person that if the straying animal is of the value of less than $20 and sequestration proceedings are instituted against the city before a Justice of the Peace holding as does the Honorable Chas. T. Rowland, it may become necessary for the city at some future date to resort to the District Court for injunction, as the majority of small animals that stray are of less value than $40.

I therefore respectfully ask that you receive and file my report.
