STATE OF TEXAS } TARRANT COUNTY }

This Agreement, made and entered into this 21st day of January 1901 by and between _________________ parties of the first part, and F. O. BROWN and R. K. DABNEY, composing the firm of BROWN & DABNEY, parties of the second part, Witnesseth:

Whereas, the City Council of the City of Fort Worth, Texas, by resolution adopted January 19, 1900, permitted and authorized the owners of property abutting Main, Houston and Rusk Streets, and the cross streets thereof in said City, to have the streets lying in front of there property excavated and paved, the owners of said property to pay for same; and whereas, said parties of the first part are the owners in fee simple of the following described lot or parcel of ground, lying and being situated in said City of Fort Worth, Tarrant County, Texas, to wit, Lot _______ in Block 41 Addition to said City, fronting 32'/3 feet on said Main Street, corner of 3rd and running back a distange of ____________ feet therefrom:

Now, therefore, in consideration of the benefits to accrue to said property in the probable enhancement of its value by reason of the said street paving in front of same, and in consideration of the covenants and promises of parties of the second part hereinafter set out, parties of the first part agree _____ and bind themselves to pay to said parties of the second part the sum of One Dollar and Seventy-five cents for each square yard of paving, and thirty cents per cubic yard for all earth excavation required for same. [left margin] The paving and excavating in front of these 32 feet 4 in. shall not cost exceeding $135.80. [/left margin] Said paving to correspond in width to the frontage of said lot, as it abuts on said street, and to extend outward from the front curb line of said lot into said street to within eighteen inches of the nearest parallel or other rail of any street car track situated on said street.

And to secure the payment of the sums of money accruing and to accrue with said parties of the second part under this contract, said part ____ of the first part do ____ hereby impose a mortgage lien on the above described lot and premises, which said mortgage lien shall exist and continue in full force and effect until all and every sum of money accruing and to accrue under and by virtue of this contract shall have been fully paid off, satisfied and discharged, by part ____ of first part.

And in consideration of the aforesaid covenants and agreements, to be performed by said parties of the first part herein contained, said parties of the second part obligate and bind themselves to furnish and provide the material and supply the labor, and perform the work necessary to pave said street in front of said lot the said parties of the first part, of the width and full distance outward from the front curb line of said lot, as herein stipulated.

The material for said paving to consist of a concrete foundation with a top layer of vitrified brick, in accordance with the specifications attached to the contract of parties of the second part, with the city of Fort Worth, in respect to the paving of the Al Hayne triangle, adjacent to the Texas & Pacific Passenger Station. Work on the within contract to begin on five days notice day of from City Engineer, 19001, and to be completed and finished on the within thirty days thereafter, 1901. The money herein contracted to be paid for said paving to become due and payable on presentation, by parties of the second part, of a certificate from the city engineer of the city of Fort Worth, showing the quantity of work done and performed, and evidencing the completion of same. Parties of the second part are to keep said paving in repair for the full period of five years from the date of the completion of said work, but are not to be held responsible for any damage to said street except as the same may be occasioned by usual and reasonable traffic on same.

In witness whereof, the parties to this contract have hereunto subscribed their names in duplicate, on the day and year hereinabove written. Queen City Lodge #21 and Red Cross Lodge #14 Knights of Pythias by J. B. Littlejohn Chairman of Trustees E. B. Randle Secretary of Trustees Brown & Dabney

STATE OF TEXAS,} TARRANT COUNTY.} Before me _________________________________________ a Notary Public in and for Tarrant County, State of Texas, on this day personally appeared ______________________ _________________ a member of the aforesaid firm of Brown & Dabney, composed of F. O. Brown and R. K. Dabney, and ____________________________________ known to me to be the persons whose names are subscribed to the foregoing instrument, and acknowledged to me that they executed the same for the purposes and consideration therein expressed. And the said _____________________________ ___________________________________ further acknowledged the same to be the act and deed of the same firm of Brown & Dabney.
