The Chairman from the Committee on Water Works brought up a Report (number 1185 Book G) which was read.

Ald Elliott moves seconded by Ald Walkem.

That the report of the Committee on Water Works be received and adopted.

In Amendment 1st

Ald Horn moves seconded by Ald G Robinson.

That the amount of the account I.E. $50 of Collins Bay Rafting Company be paid.

In Amendment 2nd

Ald McKelvey moves seconded by Ald McIntyre.

That the sum of $50 as charged by the Collins Bay Rafting Company for the removal of the Rouseau pipe be paid said amount to be afterwards collected from the owners of said pipe as we may be advised by the City Solicitor - which being put was lost and the first amendment being put was carried.

Yeas: The Mayor, Aldn Allen, Behan, Carson, Curtis, Horn, Mundell, McIntyre, McKelvey, G Robinson, Skinner Walkem - 12.

Ordered That the report of the Committee on Water Works be received and adopted as amended.

The Chairman from the Court of Revision brought up a Report (number 1186 Book G) which was read and adopted.

The Chairman from the Committee on Fire, Water and Light brought up a Report (number 1187 Book G) which was read and adopted.

The Chairman from the Committee on Parks brought up Report (number 1188 Book G) which was read and adopted.

On Motion of Ald Curtis seconded by Ald Carson.

Ordered That the Police Commissioners be requested to swear in William Phillips as a constable for special duty in connection with the City Parks.

Ald Carson introduced a By Law to authorize the construction of a common sewer in a part of Balaclava Street in the City of Kingston as a local improvement under the provisions of the Municipal Act on that behalf which was read a first time.

The 30th Rule was suspended and the Council went into Committee of the whole on the second reading

Ald Walkem in the Chair.

The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - The Report was recieved.

The 30th Rule was again suspended and the By Law was read a third time and passed.

On motion the Council adjourned.

Ald McIntyre brought up the petitions of James Gowdey and Edward Lark respecting Taxes

On motion of Ald: McIntyre seconded by Ald: McRossie Ordered, that the petitions of J. Gowdey and E. Lark be referred to the Court of Revision to report.

Ald: McIntyre brought up the petition of Ephraim Brown respecting Taxes

On motion of Ald: McIntyre seconded by Ald: McRossie Ordered, That the petition of E. Brown be referred to the Court of Revision.

Ald: McIntyre brought up the petition of M. Foley and ten others Carters on the subject of suing for their fares

On motion of Ald: McIntyre seconded by Ald: Drennan Ordered, That the Committee on City Property be authorized to take steps to ensure the City's interest in the Court House.

Ald: McIntyre moves seconded by Ald: Gildersleeve That His Worship the Mayor be authorized in conjunction with the City Solicitor and such Committees as may be requisite to take such steps as will ensure a full investigation into the recent fires on Princess Street which occurred in the stores of Mitchell and J.M. McKay & Co - which being put was lost.

A Meeting of the Council of the Corporation of the City of Kingston was held this day. Present

The Clerk read the minutes of the last meeting.

A Communication from William J. Minnes was read asking for an extension of time for the Collection of Taxes.

On motion of Ald: McIntyre seconded by Ald: McRossie Ordered, That the Collector of Taxes be authorized to continue the levy and Collection for balance of Taxes for 1876 until the first day of April next.

A Communication of A. Walsh was read asking for a remission of a fine imposed on him.

On motion of Ald: McIntyre seconded by Ald: Gaskin Ordered, That the Communication of R. Walsh be referred to the Mayor with power to act.

Communications from George A. Kirkpatrick Esquire were read one enclosing statement of cost of re-building the

Tuesday 7:30 OClock P.M. Kingston February 13 1877

A Special meeting of the Council of the Corporation of the City of Kingston was held this day. Present:

His Worship the Mayor.

Aldermen:

Allen, Asselstine, Campbell, Carson, Drennan, Gaskin, Harty, Metcalfe, Mooers, McCammon, McIntyre, McRossie, Pense, Powers

The Mayor stated the meeting was called to consider By Laws read a first time yesterday and other unfinished business.

The Council went into Committee of the whole on the second reading of the "By Law to raise by way of loan the sum of $25,000 for the purposes hereinafter mentioned"

Ald: Allen in the Chair. The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - the Report was received

Aldn: Clements and Gildersleeve here entered.

The Council went into Committee of the whole on the second reading of the "By Law respecting Tavern and Shop Licenses in the City of Kingston.

Ald: Clements in the Chair. The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - the Report was received.

Yeas: Mayor McKelvey, Aldn: Carson, Clements, Gaskin, Gildersleeve, Metcalfe, Mooers, McCammon, McIntyre, McRossie, Pense - 11.

Nays: Aldn: Allen, Asselstine, Campbell, Drennan, Harty, McDermott, Powers - 7.

The 29 Rule was suspended and the the By Law was read third time and passed.

Ald: Gaskin moves seconded by Ald: Allen That seeing a certain drain in Clergy street was opened last spring from a house belonging to Alderman Carson solely for the purpose of draining said house, said drain having been opened contrary to the rules of this Council, yet nevertheless the City has been made liable in law for injuries received by a person named "Adair" he having fallen into said drain and for which the City has had to pay a large amount namely $701 including costs, from the evidence given at said trial it was shown that Alderman Metcalfe had caused said drain to be opened, thus using his powers as an alderman contrary to the rules of this Council, and the City Solicitor be requested to report, giving his opinion as to whether either or any of the aldermen above mentioned can be made liable to the City for their acts so illegally done.

In amendment Ald: McIntyre moves seconded by Ald: McRossie That the City Solicitor be requested to deliver to this Council his opinion as to whether this Council can recover damages against any individual Alderman ordering public work to be done in the City without the authority of the Council on the appropriate Committee, which work has resulted in damage to any party who has recovered against the City for the same - which being put was carried and the original motion was lost.

Yeas: Aldermen Allen, Asselstine, Campbell, McDermott, McIntyre, McRossie, Pense, Power Powers - 8

Nays: Alermen Drennan, Gaskin, Gildersleeve, Harty, Metcalfe - 5.

A Communication from Charles Field was read requesting that the Crossing in front of his property Gordon street be finished.

On motion of Ald: Walkem seconded by Ald: Carson Ordered, That the Communication of Charles Field be referred to the Committee on Streets to report.

Communications from James Agnew Esquire City Solicitor was read on the subject of the issue of $25,000 Debentures, the power of the Council as to remission of fines.

Ald McIntyre brought up the petition of Richard Tossell praying permission to lay down building materials on King, Johnson and Brock streets.

On motion of Ald: McIntyre seconded by Ald: McRossie
