Inspector of the River and one of my Tide Surveyers of tracing the finders & sellers of the quantities of Foreign Tallow undermentioned, which ought to have been delivered to the Receiver of Wreck - viz C grs lbs £ s d. James Parker 2 8 . 13 -- 5 . 8 -Farm labourer Thomas Page } Stone 2 . 3 . 17 -- 5 . 10 . -William Green Gatherers 3 . 25 -- 1 . 16 . 11 The Tallow was found on the Beach on the 1st Instt by the men above named who reside at the village of Great Cowden a few miles south of Hornsea. It is no doubt part of the same cargo, large quantities of which have been cast on shore, within a few miles of Hornsea, and clandestinely taken away and sold. Mr John Jackson Tallow chandler of this Town has deposited with me the amount he paid for the Tallow -- viz -- £12.14.11 and sent the man with my Officers to identify the men from whom he bought the Tallow. It is quite necessary that an example should be made of all the men engaged in this transaction to bring the district into a state of discipline that proper respect may be paid to the Law. With reference to your Letter of the 26th Ulto. on the subject of proceedings against William Danby of Ulrome and four others. - I beg to acquaint you that they have been summoned to appear at Leaven on the 8th Instant. In that letter you inform me that the sale price may be deemed tha fair value of the Tallow and that the Magistrates may determine the portion to be paid by each. £23. The Magistrates will most likely divide the Penalty equally or £4.12.0 each - and - as all the men are poor, probably add 1/ for the second penalty. And with reference to the 19th section of the Act 11 & 12 Vict ch 43 as distress warrants will no doubt be [ominous?] to the men, and their families - they will have be committed For how long should they be committed. [J.H.?] ------------------------------------------------------------------------------------J C Dowd Esq London Sir, 4th April 1858 By the aforegoing it appears that you are of opinion that in the event of the parties being committed Gaol, the form of imprisonment must be left to the parties. Such is not the opinion of the Justices Clerk. In a conversation I had with him yesterday on the powers of Justices under the 19th Sect of 11 & 12 Vict c 43 - he referred back to the 518 Sect of M S Act 1854 pt 3 - and observed that in his opinion, the Justices could not commit for a longer period than six months - Is that good Law. Not that I suppose committal for a longer period would be deserved, - But if the committal should be till penalty be paid, be so good as to point out to me the Section. of Mr Smith would convict Barker, if he did not plead guilty, which he most likely would. Barker could then be made a witness against the other two. No reference whatever would be necessary in the proceedings to any explanation made to Lieutt Stewart. I trust therefore that with this explanation proceedings against the parties will be allowed to go on. Sir, 9th April 1858 With reference to my letter of the fifth instant returning papers respecting Leonard Barker and two others-------- I beg to acquaint you that ----yesterday----- the further following facts of the misconduct of these parties came to my knowledge that on the night of the viz 27th Feby last -- McCardy one of the Coast Guard men at the Ulrome Station, --- met Willisen and Smith driving two Donkeys with paniers from the shore at about 7/30 PM. The paniers were filled with Tallow

and he desired them after an explanation with them where they had obtained it, - which they said was on the sea shore - to take it to the Barn of Mr Jordan - Farmer at Skillington Hill, which was close by. They then went to the shore and fetched a second lot, which was also placed in the Barn, but after McCardy left them they took some away and sold it to Mr Smith of Brandes Burton. The next night -vizthe 28th John Prophet - another of the Coast Guard men at the Ulrome Station - found the same two men on the sea shore at about 9 O Clock with a quantity of Tallow which they had collected together and desired them to take it to Mr Jordan's Barn, - but as he had to go further where there were other lots of Tallow he could not follow them, and there is no doubt but that they took a portion away and sold it to Mr Smith. These men also delivered to the Officers of Captain Palmes who is the receiver in the Bridlington District C 7.2.5 of Tallow which they had gathered on the shore, which has been sold for £16.11.11 - The lot stands No 11 - on his Report Book. Should not these men, with reference to Sectn 450 of the M S Act of 1854 forfeit their Salvage on that droit. The three men mentioned in this paper are among the most difficult to be managed in wreck matters along the part of the Coast where they reside JS. ---------------------------------------------------------------------------------------------- J C Dowd Esq.
