My Lords of the Privy Council for Trade having had under consideration the offences recently committed by John Smith Leonard Barker and Robert Willisen, of having taken from the sea shore near Atwick, certain quantities of Tallow which were Droits of Admiralty and sold the same to William Smith of BrandesBurton as below stated ----------viz ---------Tallow. I will therefore thank you to call upon the men above named to give up to you the respective amounts before mentioned, - and report the result. With reference to your Letter of the 9th Inst, respecting the master and crew of the "Exchange" of Sunderland, I beg to acquaint you that they arrived from Harlingen on the 18th Ulto in the Steamer "Minister Hornbeck" and were, immediately on their arrival, forwarded to their homes at Sunderland by the Honorary Agent of the shipwrecked Fishermen and Mariner's Society. That Gentleman also forwarded to their homes, viz, - Newcastle, on the 29th Ulto, the master and crew of the "Lord Althorpe" with Coals from Newcastle to Sweinemunde which had been wrecked at some place abroad - and also the Master and crew of the "Effort" wrecked at the mouth of the Elbe. They arrived here on the 4th inst, and were immediately forwarded to Newcastle. I have requested that in the furture whenever parties arrive from abroad under circumstances similar to the above they be brought to my Office. A reference to the Receiver of Wreck at Newcastle and Sunderland will clean up those matters. Receiver of Wreck C Ho Hull, is informed that under all the circumstances of this case the sum of £12 " 14. 11 may be returned to Mr Jno Jackson RM April 14th /58 Before giving final directions in this case the Board would be glad to know whether the Collector thinks Mr Jackson was really ignorant that the Tallow was wreck J H Farrer 14 April /58 The Tallow was purchased by Mr Jackson's Foreman - Parker and Page first went to Mr Jackson at his shop in Myton Gate - and said they had some Tallow for sale - which is a common occurence He desired them to take it to his warehouse or Candle manufactory - where they sold it to his man, who weighed it, and gave them a note thereof, and of the sum to be paid. They took it to Mr Jackson who paid the amount as he does in other cases & while paying the men the £12 . 14 " 11 he inquired where they got the Tallow, and they informed him they had picked it up on the shore at Cowden. He inquired the situation of Cowden, and they informed him it was near Hornsea - About an hour after he went to his manufactory, - and when he saw it he complained that his foreman had given too much for it, and desire him not to purchase any more of the same sort. - When my Officers went to Mr Jackson's premises and explained to him the object of their visit was search of Tallow which had lately been picked up on the sea shore - he gave every assistance in his power to trace the men from he purchased the lot in question As he did not know their names he allowed his man to accompany my officer to identify, and also at Leaven - he fully explained all matters to the Magistrates The men had melted the Tallow before they took it to Mr Jackson and run it into Pans and tubs. The price his man gave to it 4/9 per stoneof 14 lbs was fair for

Since my Officers called upon him on the subject his proceedings have been in all respects satisfactory so as to enable me to convict the wreckers. Mr Heaton Foster - the junior partner of the firm of Messrs Robt & H Foster purchased the C 5 . 3 0 Tallow in question from Mr Statters Carrier. When he did so he inquired of Mr Statters where it came from, who replied that it was wreck tallow. He then inquired whether the Lord of the Manor had any claim on it, and was informed that he had not. He states that it did not strike him to make any further inquiries - but purchased the same - and for which he gave a fair price in its changed state even had it been duty paid. When my Officers called at his shop he fully explained everything to them - and looked out for the carrier from whom he purchased it the next market day - as his name was not known to him - His conduct throughout - since my Officers called upon him - has been in every respect satisfactory in enabling me to convict the wreckers. Mr Wm Danby are detailed in my Wilkins has sent the money to the Bd Letter to Secretary Marine Department of Trade as the double value of Wreck B. T. dated 12th instant - viz - is not to be paid to him the Double value of } Board will hand over the Penalty 1/5 of Tallow 4 " 12 " 0 which he is to receive as soon as the Penalty - " 10 . 10 amount is known.
