William Danby immediately paid the said sum of £6 ------and in default of payment John Shot Francis Smith John Smith and Robert Frankish were each committed to the House of Correction - without hard Labour for six weeks, unless they severally, sooner paid the sum of £6 " ----- I am unable to forward the expense of prosecution as the Justices Clerk was going from home for a fortnight immediately he left the Court. - On his return he will furnish me with his account. As the Justices Clerk was going from home for a fortnight immediately he left the Court I am unable to forward costs of proceedings till he returns. With reference to my Letter of the 19th Ulto, acquainting you that Messrs Robt & H Foster soap and candle makers in this Town had deposited with me the sum of £11.10.0 in respect of C [which?] 5.3.0 of Foreign Tallow which they had purchased from Robert Statters of Skipsea Brough - the said tallow having been picked up on the sea shore by William Danby and four others and entrusted by them with Statters for sale Statters got tipsy before he returned home and forgot the amount for which he sold the Tallow, and Therefore accounted to Danby and his partners for £6.10 only. a few days afterwards. I therefore demanded the £5 from Statters which he had not accounted and have impounded the same. On the 8th inst I proceeded against Danby and his four partners, - under the 450th Section of the M S Act 1854 in respect of the said Tallow before the Magistrates at Leaven, - who convicted each as follows - viz - Double Value } of 1/5 of Tallow 4. 12. 0 Penalty --" 10. 10 Costs --" 17. 2 --------------- Total £ 6. 0 " 0 Danby immediately paid £6. - " - and was liberated. and the other four men - not having any goods whereon to levy distress without ruin to those who have families they were each committed to the House of Correction without hard Labour ---for the space of six weeks unless the Penalty and costs as aforesaid were sooner paid. C qr lbs I have therefore in hand in respect of the said 5. 3 " 0 of Tallow -- the following amounts --------- viz -------- £ s. d Deposited by Messrs Foster 11. 10. 0 Impounded from Statters 5. 0. 0 Penalty and costs from Danby 6. 0. 0 -------------- Totals £22 " 10 " 0 Mr Foster Junr attended at Leaven on the 8th instant which is 14 miles from hence, and gave evidence in the case. -- Messrs Foster - Therefore ---- as all parties con-cerned in commission of the offence have been convicted request that the £11 " 10.0 which they deposited with me to represent the said Tallow, - may be returned. From the ready manner in which Messrs Foster came forward and afforded every explanation in their power of the matter - their application appears to me - to merit a favorable consideration. I reported the conviction of Danby and partners in a Letter dated the 10th Inst addressed to Mr O Dowd JS ---------------------------------------------------------------------------------------------

Annexed is an application from Mr John Jackson for the return of the sum of £12 " 14. 11, which he deposited with me, as reported in my Letter to you of the 29th Ulto to represent the respective quantities of Foreign Tallow undermentioned which had been picked on the sea shore at Cowden - by - Sold for C qr lbs £ s. d. James Parker --- 2 " 3 " 13 ---- 5 " 8 " 0 Thomas Page --- 2 " 3 .17 --- 5 " 10 " 0 William Green --- -- " 3 " 25 --- 1 " 16 " 11 -------------------- £. 12 " 14 " 11 On the 8th Instant I proceeded against three three men above named before the Magistrates at Leaven, 14 miles from hence, when Mr Jackson attended and gave evidence on the matter - and the men were convicted each in double the amounts set opposite their names, -- each in a Penalty of s 10/= -- and each in £1 " 2. 0 Costs. ---- Parker - whose conviction was as follows - viz - Double value -------- £10 " 16. 0 Penalty --- 10. --- Costs 1 " 2 " --- --------------------------- £12 " 8. 0 That amount was immediately paid and he was liberated ---- In default of payment, and not having goods whereon to levy distress without ruin to their families -- Page was committed to the House of Correction ---- without hard Labour for six weeks -- and Green for one month, which I reported to Mr O Dowd in a letter dated the 10th Instant. ------ Mr Jackson most readily gave every assistance in his power in the matter - and his application therefore appears to me to merit a favorable consideration JS. ------------------------------------------------------------------------------------------
