In 1846 Kingston was incorporated as a city. There had from the beginning been considerable dissatisfaction with the original incorporation act. It had been felt that there were too few councilors, and there was no provision for proper assessment. After 1846 the council increased in size and the councilors were elected annually. The city limits were extended and the whole was divided into five wards: Cataraqui, Frontenac, Sydenham, Ontario and St. Lawrence. By the 1849 Baldwin Act, city limits were again increased and Rideau and Victoria wards were added. At that time the Council consisted of the mayor, fourteen aldermen and fourteen councilmen. In 1867 the Council was reduced to the mayor and twenty-one members, three from each ward, and all were called aldermen. The items to be described are two volumes of City Council minutes from 1886-1897. These minutes will be of particular value once transcribed as we have never received indices for 1880 to 1896. All other years are indexed making the information more findable.

Now this Agreement Witnesseth as Follows:

The said company is hereby authorized and empowered by said corporation after the expiration of the year 1899 to construct maintain and operate in lieu of single track railway at present constructed and being operated by the company a double track iron or steel railway of uniform gauge with the Co's present railway along Princess St in said city from the western end of the switch opposite the Orange Hall on said street to Bagot St. but subject to terms of this agreement.

(2) If after the expiration of the year 1899 the said company shall construct a double track railway as in the preceding paragraph mentioned and the roadway along which the same is constructed is not at the of such construction paved with asphalt brick granite blocks or other permanent pavement then the entire cost of making the changes in said roadway rendered necessary in the judgement of the City Engineer of said Corporation by the construction & laying down of said double track railway shall be borne and paid by said Co.

(3) If at the time of the construction of the said double track railway or at any time thereafter the said corporation shall construct and lay down an asphalt brick granite blocks or any permanent pavement on Princess St. from King to Bagot St. The said Company shall pay to the said Corporation one fifth of the total cost of such permanent pavement between curb & curb for the entire distance from King to Bagot St. and including the squares at the intersection of Princess Street & King Street & of Pricess Street & Bagot Street and shall thereafter from time to time pay to the said Corporation one fifth of the cost of the maintenance and repair of such permanent pavement.

(4) If the double track railway hereby permitted shall be constructed in and along the macadam roadway on Princess Street and thereafter the said corporation desire to pave said street with asphalt brick granite blocks or other permanent pavement then the said Co shall at their expense take up and relay their tracks besides paying as herein before provided one fifth of the cost of constructing said permanent pavement.

(5) In case at any time the said corporation decide to construct an asphalt brick granite block.

or other permanent pavement upon that portion of Princess St between King & Bagot St and the said Co. shall not at that time have constructed the double track railway hereby permitted the said Corporation shall give to said company notice of their decision & intention to construct such permanent pavement and thereupon & there after the said Co. shall proceed to construct & shall construct the said double track railway concurrently with the construction of said permanent pavement and in case after said notice the said company shall fail to construct said double track railway promptly and expeditiously and so as not to hinder or delay the construction of said permanent pavement then the said corporation may lay down and construct said permanent pavement and the said company shall at their own cost and charge take up and relay their railway on and along the portion of Princess St. so paved and in case at any time after such permanent pavement has been constructed the said company shall desire to lay a double track railway along the said portion of Princess St as hereinfore mentioned then in such case the work. The work of taking up altering and relaying said permanent pavement so far as required to admit such double track railway being laid shall be done by the said corporation but the total cost of taking up altering and relaying shall be paid and borne by said company and the said company shall thereafter pay to said corporation one fifth of the entire cost of the maintenance of such permanent pavement as in clause (B) of this agreement mentioned.

(6) All the work and materials required in and about the construction of the double track railway hereby permitted shall be done and supplied by said company at their sole cost and charge.

7 The company shall pay to the said corporation all moneys payable under this agreement within thirty days after the presentation of the account therefore by the City Treasurer of said Corporation and the City Engineers Certificate of the amount so payable shall be binding and final on the company and Corporation.

8 Except altered by this agreement the terms and stipulations contained in the agreement between the said Corporation and the Kingston Street Railway Company dated 9th May 1893.

and in this agreement between the said corporation and Kingston Portsmouth and Cataraqui Railway Company dated 7th May 1894 respecting the removal of snow and ice from the street shall apply to the double track railway hereby authorized to be constructed.

9 When the said permanent pavement is being laid upon said portion of Princess Street the Co shall at their own cost and expense construct their track on said portion of Princess St of rails to be approved by City Engineer.

(10) The permission hereby granted to lay down construct and operate said double track railway along Princess St is granted only on condition that the said company shall not later than the 1st day of June A.D. 1898 complete and commence operating the railway contracted to be built by said company by agreement between them and said corporation dated the 23rd day of November A.D. 1896 and in case the said company shall fail to construct the railway as in said agreement of the 23rd day of November A.D. 1896 provided then and in such case the permission and authority hereby granted to construct and operate a double track railway shall be revoked and annuled and the said Company shall forfeit and pay to the said Corporation the sum of one thousand Dollars liquidated damages and the time fixed for the completion and the commencement of running cars by said agreement dated 23rd day of Novemebr A.D. 1896 is hereby extended to first day of June A.D. 1898.

Carried.
