Now this Agreement Witnesseth as Follows:

The said company is hereby authorized and empowered
by said corporation after the expiration of the year
1899 to construct maintain and operate in lieu
of single track railway at present constructed and
being operated by the company a double track iron
or steel railway of uniform gauge with the Co's
present railway along Princess St in said city from
the western end of the switch opposite the Orange
Hall on said street to Bagot St. but subject to terms
of this agreement.

(2) If after the expiration of the year 1899 the said
company shall construct a double track railway as
in the preceding paragraph mentioned and the
roadway along which the same is constructed is not
at the of such construction paved with asphalt brick
granite blocks or other permanent pavement then
the entire cost of making the changes in said roadway
rendered necessary in the judgement of the City
Engineer of said Corporation by the construction &
laying down of said double track railway shall
be borne and paid by said Co.

(3) If at the time of the construction of the said double
track railway or at any time thereafter the said
corporation shall construct and lay down an asphalt
brick granite blocks or any permanent pavement on
Princess St. from King to Bagot St. The said Company
shall pay to the said Corporation one fifth of the
total cost of such permanent pavement between
curb & curb for the entire distance from King to Bagot St.
and including the squares at the intersection of
Princess Street & King Street & of Pricess Street & Bagot
Street and shall thereafter from time to time pay to the
said Corporation one fifth of the cost of the maintenance
and repair of such permanent pavement.

(4) If the double track railway hereby permitted shall
be constructed in and along the macadam
roadway on Princess Street and thereafter the
said corporation desire to pave said street with
asphalt brick granite blocks or other permanent
pavement then the said Co shall at their expense
take up and relay their tracks besides
paying as herein before provided one fifth
of the cost of constructing said permanent
pavement.

(5) In case at any time the said corporation decide
to construct an asphalt brick granite block.
