and in this agreement between the said corporation
and Kingston Portsmouth and Cataraqui
Railway Company dated 7th May 1894 respecting
the removal of snow and ice from the street shall
apply to the double track railway hereby authorized
to be constructed.

9 When the said permanent pavement is being
laid upon said portion of Princess Street the Co
shall at their own cost and expense construct
their track on said portion of Princess St of
rails to be approved by City Engineer.

(10) The permission hereby granted to lay down
construct and operate said double track railway
along Princess St is granted only on condition that
the said company shall not later than the 1st day of
June A.D. 1898 complete and commence operating
the railway contracted to be built by said company
by agreement between them and said corporation
dated the 23rd day of November A.D. 1896 and in
case the said company shall fail to construct the
railway as in said agreement of the 23rd day of
November A.D. 1896 provided then and in such
case the permission and authority hereby
granted to construct and operate a double track
railway shall be revoked and annuled and the
said Company shall forfeit and pay to the said
Corporation the sum of one thousand Dollars
liquidated damages and the time fixed for the
completion and the commencement of running
cars by said agreement dated 23rd day of Novemebr
A.D. 1896 is hereby extended to first day of June A.D. 1898.

their hands and seals the day and year first above

that consent of this Council be granted to
change a clause in By Law introduced at
last meeting of Council in regard to Polling sub
division No 4 Ontario Ward substituting Mrs
Caulfield's house Bagot St Polling Sub-division
No. 20 Victoria Ward substituting William
Tweed Deputy Returning Officer. Carried.
