Monday 7:30 O'Clock P.M. Kingston December 18 1876

A Meeting of the Council of the Corporation of the City of Kingston was held this day. Present

His Worship the Mayor Aldermen Allen, Carnovsky, Carson, Clements, Drennan, Dupuis, Harty, Metcalfe, McCammon, McIntyre, McKelvey, McRossie, Pense, Powers, Tandy, Thibodo, White

The Clerk read the minutes of the last meeting

The Mayor submitted to the Council a Patent purporting to be Ordnance Land Sale Grant to "the Corporation of the City of Kingston" a parcel of land of the property known as the "Herchmer Farm" situate[d] in the City of Kingston, to be used as a Public Park (dated January 19 1876)

A Communication from James Agnew Esquire City Solicitor was read In Re Adair vs Kingston and Montreal street.

A Communication from Mrs Jane Garret, Sharbott Lake was read asking payment of Ten dollars for bed clothes destroyed sent with man taken with Small Pix and sent to Kingston Hospital.

On motion of Ald: Drennan seconded by Ald: Price Ordered, that the communication of Jane Garret be handed to the County Clerk and that the City Clerk notify her to that effect.

The Mayor mentioned that he had been served to-day with an appointment for the 26th instant for proceeding with the arbitration between the City and County in reference to the Court House

A Communication from E.J.B. Pense Esquire was read asking the Council to relieve the British Whig of its Contract for Printing.

On motion of Ald: Drennan seconded by Ald: Harty Ordered, That the Communication of E.J.B. Pense in regard to agreement for Contract for Printing with the City and that said Pense be relieved of said Contract

A Communication from Messrs Kirkpatrick and Rogers. In Re Canadian Engine & Machinery Company Taxes was read

On motion of Ald: McIntyre seconded by Ald: Price Ordered, That the Communication of Messrs Kirkpatrick and Rogers be referred to the Court of Revision to report

A Communication from the Department of the Interior was read enclosing Letters Patent in favor of the Corporation of the City of Kingston for a Park

Ald: Drennan brought up the petition of V Wemple

A Special Meeting of the Council of the Corporation of the City of Kingston was held this day. Present

His Worship the Mayor

Aldermen

Allen, Carson, Clements, Drennan, Dupuis, Gaskin, McCammon, McIntyre, McKelvey, McRossie, Noble, Powers, Price, Tandy, White

The Clerk read the minutes of the two last meetings.

The Mayor stated he received the award of the Arbitrators in the erection of Court House which he submitted.

A Certificate from Michael Flanagan, City Clerk was read in Re votes in the Power Dry Dock By Law

A Circular from John Hallam Esquire Chairman of Committee Toronto was read enclosing report of Special Committee on taxation exemptions.

A Communication from C.V. Price Esquire was read stating the Directors of the Kingston Street Railway will not press any change of width of track at present.

A Communication from James Agnew Esquire, City Solicitor was read in re Adair verdict sustained.

A Communication from John Creighton Esquire was read in Re Arbitration Court House between County and City.

Petitions from John McMahon, W.B. and S. Anglin and John Holmes respecting Taxes and referred to the Court of Revision.

Ald: Gaskin brought up the petition of [strikethrough] Mary Dandy [/strikethrough] William McCartney praying permission to lay down building materials on Gordon Street Victoria Ward.

On motion of Ald: Gaskin seconded by Ald McKelvey Ordered, That the petition of William McCartney be granted on the usual Conditions

Ald: Allen brought up the petition of Mary Dandy praying for a remission of fine

On motion of Ald Allen seconded by Ald: Drennan Ordered, that the petition of Mary Dandy be referred to His Worship the Mayor with power to act.

Ald: McRossie from the Committee on Finance and Accounts brought up [strikethrough]a[/strikethrough] two Reports (Numbers 535 & 536 Book D) which [strikethrough]was[/strikthrough] were read and adopted.

The Chairman from the Committee on Fire, Water And Gas brought up a Report (Number 537 Book D) which was read.

Ald: Tandy moves seconded by Ald: McCammon That the report of the Committee on Fire, Water and Gas be received and adopted.

Tuesday 7:30 OClock P.M. Kingston February 13 1877

A Special meeting of the Council of the Corporation of the City of Kingston was held this day. Present:

His Worship the Mayor.

Aldermen:

Allen, Asselstine, Campbell, Carson, Drennan, Gaskin, Harty, Metcalfe, Mooers, McCammon, McIntyre, McRossie, Pense, Powers

The Mayor stated the meeting was called to consider By Laws read a first time yesterday and other unfinished business.

The Council went into Committee of the whole on the second reading of the "By Law to raise by way of loan the sum of $25,000 for the purposes hereinafter mentioned"

Ald: Allen in the Chair. The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - the Report was received

Aldn: Clements and Gildersleeve here entered.

The Council went into Committee of the whole on the second reading of the "By Law respecting Tavern and Shop Licenses in the City of Kingston.

Ald: Clements in the Chair. The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - the Report was received.

Yeas: Mayor McKelvey, Aldn: Carson, Clements, Gaskin, Gildersleeve, Metcalfe, Mooers, McCammon, McIntyre, McRossie, Pense - 11.

Nays: Aldn: Allen, Asselstine, Campbell, Drennan, Harty, McDermott, Powers - 7.

The 29 Rule was suspended and the the By Law was read third time and passed.

Ald: Gaskin moves seconded by Ald: Allen That seeing a certain drain in Clergy street was opened last spring from a house belonging to Alderman Carson solely for the purpose of draining said house, said drain having been opened contrary to the rules of this Council, yet nevertheless the City has been made liable in law for injuries received by a person named "Adair" he having fallen into said drain and for which the City has had to pay a large amount namely $701 including costs, from the evidence given at said trial it was shown that Alderman Metcalfe had caused said drain to be opened, thus using his powers as an alderman contrary to the rules of this Council, and the City Solicitor be requested to report, giving his opinion as to whether either or any of the aldermen above mentioned can be made liable to the City for their acts so illegally done.

A meeting of the Council of the Corporation of the City of Kingston was held this day. Present:

His Worship the Mayor Aldermen Allen, Asselstine, Campbell, Carson, Drennan Dupuis, Gaskin, Mooers, McDermott, McIntyre, Noble, Price, Walkem

The Clerk read the minutes of the two last meetings.

A Communication form Alderman John Hallam Toronto was read related to exemption from Taxes.

On motion of Ald Drennan, seconded by Ald Allen Ordered, That the Communication of the Corporation of the City of Toronto be referred to a Joint Committee consisting of the Finance Committee and the Court of Revision to report.

A Communication from Alfred Le Richeux was read stating certain articles are required for the new Registry Office.

Ald. Allen moves seconded by Ald. Gaskin. That the Communication of Deputy Registrar in reference to Furniture be laid on the table.

In amendment Ald. Carson moves seconded by Ald McDermott That the Communication of the Deputy Registrar be referred to the Committee on City Property to report which being put was carried and the original motion was lost.

A Communication from Alexander Adair was read stating a Platform Scales are needed for Number one Market - no action taken for the present.

Ald. Metcalfe here entered.

A Communication from Messrs. Fraser & George was read respecting taxes. Referred to the Court of Revision.

A Commuication from William J. Savage was read wishing his name on the Assessment Roll. There was no action taken thereon.

A Communication from Horace A. Harback was read claiming damages sustained by him ($5.00) owing to his window being broken on the night of Phsiog: procession Oct. 16th.

Ald Allen moves seconded by Ald. Walkem That the Communication of Horace A Harback be referred to the Committee on Finance to report.

In amendment Ald Baskin moves seconded by Ald Mooers That the Communication of Mr. Harback in reference to compensation for broken window be laid on the table which being put was lost and the original motion was carried.

The Council went into Committee of the whole on the second reading of the "By Law respecting public works, contracts, purchases, Labor and supplies.

Ald Mooers on the Chair. The Council resumed. The Committee rose and the Chairman reported the second reading of the By Law in Committee as amended. The Report was received.

The 29th Rule was suspended and the By Law was read a third time and passed.

Ald Dupuis here left.

The Council went into Committee of the whole on the second reading of the By Law entitled a By Law to regulate the public markets in the City of Kingston.

Ald McCammon in the Chair. The Council resumed. The Committee rose reportetd progress and asked leave to sit again. The Report was received.

Tenders for Market Tolls were opened and read as follows:

Market No 1 James Nesbitt $2,198.00 Robert Keys - 2,367.00 William Miller - 2,278.00 Alexander Adair - 2,365.00

Market No 2 James Nesbitt - $636.00 John Holmes - 615.15 Robert Keyes - 687.00 William Miller - 721.00 James Brewster - 659.00

On motion of Ald Gaskin seconded by Ald Mooers

Ordered, That the tender of Robert Keyes for Market Number One and William Miller for Market Number Two being the highest be accepted on conditions that the security offered be approved of by the Mayor and in the event of the party not completing their security to the satisfaction of the Mayor the next lowest party completing said security be accepted.

The Chairman from the Committee on Wharves and Harbor brought up a Report (Number 644 Book D No 2) which was read and adopted.

On motion the Council adjourned.
