Dear Dr. Van Waters

Thanks for your very nice letter of December 23rd, and for your Season's Greetings.

Suit has been filed by Max D. Stern, Esq. for Gerry and John Furtado in the Federal District Court, and is before Judge Garrity. There has been an argument before Judge Garrity, who has issued a temporary restraining order against the defendants, the Commisioner and officers from opening any letters between Gerry and Mr. Furtado.

In the meantime, through Gerry's father, Mr. Stern was informed that an inmate had attacked Gerry while he was taking a shower. It was under suspicious circumstances, as the guard only allows one man out of his cell at a time. Gerry was the last man in has block to be let out for his shower, and this other inmate was let out by the guard, and then the attack occurred.

I told Mr. Stern about Mr. Flanagan being sent from Walpole to Concord, but Mr. Stern is asking that he be transferred back to Walpole as a matter of convenience so that both his clients will be at Walpole.

I gave Mrs. Cross your Christmas greeting and love. She is about the same as when I last wrote you.
