erating said railway the said Company shall furnish on
greater obstacle than necessary to the free use and
enjoyment of said streets. Said Company shall not use T
rails on said railway, and the apparatus and appliance
used thereon shall be of the latest improvement. Double
tracks may be laid along any street where the wants of
travel shall demand the same.

Sec. 3. The City Council reserves to itself the right and
power at all times to pass such rules, regulations and
ordinances in reference to the management, conduct and
operation of said street railway as the public safety and
good may require, and such police power as is usually
exercised by the municipal authorities in other cities.

Sec. 4. That the said Railway Company may adopt any
other motive power which may prove itself more
efficient than electricity, if the City Council shall by
ordinance agree thereto.

Sec. 5. That the exclusive privilege of using the streets of
said City for the purpose mentioned in Section 1 is
hereby granted to the said Street Railway Company, its
successors and assigns, for a period of thirty-seven
years from the date of the passage of this ordinance:
Provided, That if at any time after ten years after the
passage of this ordinance any person or persons shall
apply for a franchise to operate a street railway over
streets not occupied by said Street Railway Company,
nor within two blocks of any parallel railway of said
Street Railway Company, the City Council within
thirty days from the receipt of such notice, then and in
that case the said Street Railway Company shall forfeit
its franchise as to such streets so unoccupied as aforesaid:
Provided, however, That the grant of the franchise
or privileges mentioned in Sections 1 and 5 shall
