The case of the lessees against the University
to enjoin the collection of additional rent equal to the state taxes, is now
in the Supreme Court of Ohio, + there is reason to expect a decision
within a few weeks. The arguments, which are to be submitted in writing
must now be nearly completed. The decision in the Common Pleas Court
was in favor of the University, + in the District Court the case was
reserved.
A good deal of effort has been made to raise the subscription
which the Board authorized last year for the purpose of enlarging
+ refitting the library room + for purchasing additional chemical +
philosophical apparatus, circulars were sent out to the trustees, alumni +
others, few of which received even the coed respect of a reply.
Some replies came however expressing an interest and a desire to
help which were appreciated less only than subscriptions would have
been. Three of the subscription cards were returned, one with a subscription
of 20$, another with a subscription of 10$ + the third blank.
Two person Mr. E.H. Moore + Mr. John Perkins, have each subscribed
$100.00 + the whole amount raised is A few others have
promised to give something: but the prospect of realizing the sum
proposed is not at all encouraging.
Two years ago a Committee of examiner was appointed by
the Board. All the members of that Committee were present during
the whole or a part of the examinations at the close of the year.
Their reports however were sent in too late to be presented to the
Board at the last session + I therefor submit them in connection
with this report.
In the haste incident to the closing hours of our last session, we
omitted to appoint an examining committee for the present year,
but a few weeks since with the advice + consent of the Faculty
+ of the executive committee of the Board I invited Mr Horton,
Dr Waddle + Superintendent Hancock to attend the closing examinations
Mr Horton + Mr Hancock replied saying that they would not be
able to be present + Dr Waddle replied that he would attend
if possible. I would recommend the appointment of a
Committee of Examiner for the coming year.
Professor Deval has been appointed by the Superintendent
of the United States Coast Survey, to triangulate the state of Ohio.
If he accepts this appointment as he desires to do it will take
him from the institution about two months of the College year
for several years to come, He agrees to furnish a substitute
during his absence; but whether this arrangement shall be made
it is for the Board to decide. I think that it would on the
whole work no disadvantage to the institution to excuse him
for the time required.
