Martin Barney

July 24th 1887 warrant issued S. H.
Barnett debty & on oath of Jesse L Barney
charged the defendant with having on Sunday
the 24th inst made an assault upon him
and George Barney, and violently kicking
at them and taking down the gun in his
hands and threatened their lives.

Same day deft brought up and after hearing the
interchange of words by the parties, adjourned to
25th inst. Parties appeared. Adjourned by consent
of the parties to Saturday the 30th inst 9 o'clock am.
Parties having chosen Jesse Lazear, Daniel Goodwin,
and Nathaniel Lyons to assist in a compromise, to
meet as above stated. Parties notified July 30th 1887.
Parties met and affected a compromise
by which all proceedings in this case be
discontinued each party agreeing to pay one
half of the costs accrued in this case. See agree-
ment in hands of N. Lyons bearing [Given?] date
herewith. Signed by [M] Barney, G. [N or W]. Barney
and J L Barney. Dismissed accordingly
Oct 4th [recd] of M Barney three dollars and sixty
cents. His cost as per araignment of the
above parties. Recd of Jesse L Barney
three and 60/100 dollars balance of costs in full
in this case docket recd satisfaction.

$10 for [7] killed & damage to flock $25, total $35.
with costs one dollar each to S Grim & S Drake
and one dollars justice fees costs paid by clai-
mant. total $3.00 auditors receipts for their
costs on their report, and now Oct 27th/94
Justice certifies to the foregoing report and
hands same to the complainant
docket satisfied accordingly.
