To the Honorable Mayor and City Council,
Gentlemen:
With reference to the money held by the sheriff in the selling on Sunday cases appealed from the Corporation Court to the County Court, three in number, with reference to which I was given power to act at your last meeting, I would respectfully report that I hand to City Secretary herewith check for $48.00 turned over to me by the sheriff on said cases. The full amount was $60.00 from which the sheriff deducted twenty per cent commissions for collection.
It seems that the criminal code provides that the sheriff is entitled to five per cent, the clerk to five per cent and the county attorney to ten per cent. I am under the impression that the sheriff and the clerk will be entitled to their commission, but I am not at all satisfied that such is the case with reference to the county attorney, as under my construction of the law its purpose was that no fees should be paid in cases originating in the Corporation Court to the prosecuting attorney except such as are paid by the Corporation.
In view, however, of the fact that the county attorney did take part in these cases, I am informed that such was the fact, it might be well not to raise this question at this time. However, it is a matter for the Council, and if they deem the question of sufficient importance it will give me pleasure to undertake any steps which may be suggested by the Council with reference to the collection of the six dollars. which in my opinion would yet be due the city.
