Kingston February 13 1877

A Special meeting of the Council of the Corporation of the
City of Kingston was held this day. Present:

His Worship the Mayor.

Aldermen:

Allen, Asselstine, Campbell, Carson, Drennan,
Gaskin, Harty, Metcalfe, Mooers, McCammon,
McIntyre, McRossie, Pense, Powers

The Mayor stated the meeting was called to consider
By Laws read a first time yesterday and other unfinished
business.

The Council went into Committee of the whole on
the second reading of the "By Law to raise by way of loan the
sum of $25,000 for the purposes hereinafter mentioned"

Ald: Allen in the Chair.
The Council resumed.

The Committee rose and the Chairman reported the second reading
of the By Law clause by clause - the Report was received

Aldn: Clements and Gildersleeve here entered.

The Council went into Committee of the whole on the
second reading of the "By Law respecting Tavern and Shop Licenses
in the City of Kingston.

Ald: Clements in the Chair.
The Council resumed.

The Committee rose and the Chairman reported the second reading
of the By Law clause by clause - the Report was received.

Yeas: Mayor McKelvey, Aldn: Carson, Clements, Gaskin,
Gildersleeve, Metcalfe, Mooers, McCammon, McIntyre,
McRossie, Pense - 11.

Nays: Aldn: Allen, Asselstine, Campbell, Drennan, Harty,
McDermott, Powers - 7.

The 29 Rule was suspended and the the By Law was
read third time and passed.

Ald: Gaskin moves seconded by Ald: Allen
That seeing a certain drain in Clergy street was
opened last spring from a house belonging to Alderman Carson
solely for the purpose of draining said house, said drain
having been opened contrary to the rules of this Council, yet
nevertheless the City has been made liable in law for injuries
received by a person named "Adair" he having fallen
into said drain and for which the City has had to pay a large
amount namely $701 including costs, from the evidence given
at said trial it was shown that Alderman Metcalfe had caused
said drain to be opened, thus using his powers as an alderman
contrary to the rules of this Council, and the City Solicitor be requested
to report, giving his opinion as to whether either or any of the
aldermen above mentioned can be made liable to the City for
their acts so illegally done.
