by said person from the best information he can get and collect the tax thereon accordingly Section 3 Be it ordained Any persons or firm engaging in any occupation for which a tax is imposed by this ordinance at any time during the current year for which an assessment has been or may be made shall pay the tax for that year Section 4 Be it ordained That when the Board of Aldermen shall at any time order the collection of the taxes imposed by this Ordi nance the Town Constable shall proceed forth -with to assess and collect specific and ad valorem tax levied by this ordinance and pay over without delay all collections to the Tresurer. he shall also report to the Mayor at the end of every Month. an account of his said collections and as soon as his assessment roll is made out he shall deposit a duplicate there of with the Mayor Section 6 Be it ordained That the Constable shall be allowed to charge and retain two per cent on all sums collected by him under this Ordinance which shall be in full payment for his services for assessing and collecting Section 7 Be it ordained That all Ordinance heretofore passed for the purpose of raising a revenue for the town of Nacogdoches are here by repealed Section 8 Be it ordained That this Ordinance shall take effect and be of force from and after the 20th day of September 1866 Section 5 Be it ordained That if any person or persons fail or refuse to pay the specific

and ad valorem taxes levied by this ordinance when called upon or notified as herein after provided. by the Constable it shall be the duty of said Constable to make a return of the names of such delinquents together with the amount of taxes due by each to the Mayor and it shall thereupon be the duty of the Mayor to issue execution against such person or person or persons for double the amount of such taxes and costs; which execution may be levied upon any property the delinquent tax payer may own within the limits of the county of Nacogdoches and sato property sold to the highest bidder for cash thirty days notice thereof being given by advertising at the Court house door in said County which on motion was adopted.

The Committee to whom was referred the matter of examining the ordinance on the Bye Laws report thus it needs no alteration or amendment

On Motion Resolved that the Mayor aided by Alderman Rusche prepare a plan of a Bridge over the La Nana Bayou at the lower crossing and that the Mayor ad vertised for the proposals for building the same

On Motion the Board adjourned subject to the call of the Mayor A A Nelson F Voight Secretary Mayor

Nacogdoches Sep 3d 1866, Secretarys office 8 O' Clock P. M The Board of alderman met at the call of the Mayor _ Present Mayor Voigt alderman Starr Whitaker Crain Rusche & Nelson Alderman Crain was duly qualified as member of the Board to his Honor the Mayor

The minutes of the preceding meeting were read and adopted

The ordinance reported by the Mayor "Concerning Nuisances and desorderly Conduct " No. 8 of the new series was on motion unanimously adopted with slight alteration after pre dicussion of the same.

Bids for furnishing Timber for the Bridge were received from Alderman Rusche and Mr James Burns. The first proposing to deliver the timber at thirteen cents and half / 13 1/2 /- per foot / measurement to be according to common Rule of measuring hewn timber and taking the measurements of the same according to the size and number of pieces in the Mayors proposal at 1500 Feet would amount to the sum of ($ 202.50) Two hun dred and two and half dollars.

Mr Burn's proposition was to deliver the timbers by the 20th day of Sept for ($250) Two hundered and fifty dollars U.S. Currency. The proposals being require to be based upon Currency value.

The bids being considered were thought to be rather Steep & the whole matter concerning the Bridge was referred back to the Mayor for further reflection & [illegible].

It was unanimously agreed by the Board thus Mr Richard D Orton be appointed Constable for the Town instead of E.S. Houston Constable elect he [illegible] failed to give his bond in the time required by Law.

Ordinance No 8. Concerning nuisances and disorder ly conduct. Be it ordainded. - That the acts or ommissions herein after specified, shall be deemed offenses against the Corporation of the Town of Nacogdoches, and is punishable by fine, to be imposed by the Mayor in any sum not exceeding Twenty Dollars, to be inforced by arresting the dilinquent and detaining him in custoday, until the same with all Costs of prosecution shall be paid or by execution at the option of the Mayor, and which may be discharged (in case of the insolvency or inability of such delinquent to pay the same on affidavit thereof being made by the defendant, or when the Mayor may be otherwise be satisfied of the fact) by the work or labor of the party convicted, on the public streets, bridges or causeways of said Town, or other labor for the benefit of the Town, under the direction of the Mayor. Offenses against the Corporation above referred to being as follows, to wit: Sect,1, It is hereby declared an offence to ride at an unusually or extraordinarily rapid gait, any horse, mare or mule for amusement or pleasure, or upon any banter or wager, without a reasonable excuse therefor ;or to ride, lead or drive any of said animals upon the galleries of business houses, private dwellings or public buildings or enclosures within said Corporation. Sect,2, It is hereby declared an offense to be engaged in rude angry or violent quarreling, or to otherwise disturb the public peace by unnecessary noise, indecent language or exposure, or disord rly conduct of any kind within said corporation. Sec, 3, It is hereby declared an offence to draw any deadlly weapon upon any person, or to draw or expose the same in any threatening manner in any broil, contest, fight, tumult or quarrel, expect in necessary self defence, which must be made fully to appear; or to commit any assult or batter within the meaning of the Laws of the State. Sec, 4, It is hereby declared an offence to shoot fire arms in the vieinity of or upon the Public Square, in or near the Public Streets, or any place near family residences or occupied public buildings within said Corporation. Sec, 5, It is hereby declared an offense to obstruct the Public Streets or side-walks, with wood-piles, or otherweise , or to permit the dead carcass of any animal to lay upon or near the premises of any citizen of said Town, the owners or occupants of such premises being required to cause the immediate removal of such carcass to a suitable distance beyond the limits of said Corporation, or to give notice to the Town Constable and the owner of such animal if known, of the existance of such nuisance, that it may be removed, such removal to be at the Cost of the owner, if known. Sec, 6, It is hereby declared an offence to slaughter beeves or other animals in any inhabited part of the Town, where the offal may be offensive to the public, or otherwise keep or allow on one's premises any filthy place where the same shall be ofensive to any of the citizens of said Corporation in consequence of the impurity or stench arising therefrom. Sec, 7, It is hereby declared an offense to keep open on Sunday for the purpose of carrying on trade, any store or drinking saloon, or any other business house within said Corporation Drug stores and Apothecaries excepted. Sec, 8, It is hereby declared an offence to be found in idleness, and without any visable means of support. All persons found within said Corporation not making exertions to obtain a support by honest employment, shall be arrested and tried before the mayor as a vagrant, and dealt within accordance with the Laws of the State. Sec, 9 The Mayor or Constable shall have the power to call upon any citizen of said town, to aid in arresting any person or persons vio;ating the provisions of this Ordinance, or any section thereof, and any person thus refusing to aid when called upon, may be fined by the Mayor in any sum not exceeding five dollards for each and every offence. Sec, 10, That Ordinance No 3, concerning nuisnaces and disorderly conduct heretofore in existence, be and is hereby repealed, and that this Ordinance take effect from and after the 20th day of September 1866, and due notice being given thereof. Bylaws of the Corporation of Nacogdoches, April 1851 Bylaw 1st Regular meetings of the Board Alderman shall be holden on the first Mondays in each and every month at ten o clock A.M untill otherwise provided and special meetings may be ordered by the Mayor or in his absence or inability to act by any three members of the Board, the place of meetings until otherwise provided shall be the office of the secretary of the Board. and any member failing to attend shall be fined one dollar for each failure provided that such fine may be permitted by a vote of the Board on a reasonable excuse for absence being tendered

By law 2nd Five members of mine shall constitute a quorum to transact bussiness [business] [illegible] a less member may organize and adjorn

By law 3rd The Mayor of present shall preside at all meetings, but in his absence any member may be called to the chair and perform the duties in the board required of the Mayor. He shall with the secretary sign the minutes of each meeting after the same shall have been approved by the Board.
