or immediately with the work, but the officer refused to issue the writ. Even the privilege of protecting such portions of the work as are left exposed to the action of the water, has been refused them, under a threat of forcible resistance; the evident intention being to prevent the Company from taking any active measures for their own protection.

The Company have been and now are fully prepared to proceed in good faith and make such alterations in the Slide and Dam, as will forever set at rest the question of its obstructing navigation; and they have only been prevented from doing by the interference of those who seem to be aiming solely at the destruction of the Dam and water power.

The depressed condition of the times has hitherto materially retarded the movements of the Company, and prevented them from always having at their control the considerable amount of money required for their improvements. They are now, however, in such condition that if not prevented by the interference of others, during the coming summer they will put their slide in good condition and safe running order.

The foregoing statements as to the efforts and intentions of the Company and the causes which have presented their being carried out, can be fully corroborated and should be sufficient to show that the company have constantly acted in good faith; that when convinced of the imperfections of the slide, they labored to impose it; and when prevented from so doing, they indeavored to effect a compromise with the parties opposed to them.
