Sect. 6 — Jurisdictional Amount
A. When Jurisdictional Amount is Necessary (p. 228)
See exceptions, top p. 229.
B. Plaintiff—Viewpoing Rule for Determining the
Amount in Controversy.
p. 229
[Mis & M.R. Co. v. Ward] Quest:
1. What is the right?
The removal of bridge is a
remedy, not a right. The right here is the
right to navigate his boats on that river.
[Glenwood Co. v. Mutual Co.] The right here is to have & maintain
(light & power companies) his poles on this spot w/o the obstruction
of D's poles.
C. Determination of the Amount in Controversy
[St. Paul Indem co. v. Red Cab Co.] If it is capable of assessment by any
possible means, & the value is, by any
rational method $3000 +, then there is
jurisd. It's only defeated where it's
impossible to find $3000 damages.
