Sec Marine Deptt Bd Trade London Sir, 1st June 1858. With reference to my letter of the 12th March last acquainting you that a quantity of Tallow picked up on the sea shore by John Smith Leonard Barker and Mathew Willisen whichi ought to have been delivered to a Receiver of Wreck had been sold by them to Mr William Smith of Brandes Burton for the sum of £ 13 . 6 . -and that Mr Smith had resold the same to Mr Yates a Tallow Chandler at Beverley for £15 " 15 . 0 -- also that Mr Yates had deposited with me the sum last named. __ I beg to acquaint you as stated in my letters to Solicitor of Customs, for your information - of the 28th March last, and 24th Ulto, that the same sum of £13 " 6 . 0 has been paid to me by the three men named. _ I therefore - as Mr Yates' transaction in the matter was in all respects perfectly fair and legitimate _ request your directions to repay him the sum of £15 " 15 " 0 so deposited with me. Duties Act, it is liable to the import duty of 3/5 --But Mr Preston, - on the part of the Master of the "Ivy Green", objects to Mr Saxelbye, - the Receiver of Wreck for the Humber having any claim thereto

as a Droit, as he urges that the M S Act 1854 does not contain any clause equivalent to the 5th Sect 9 & 10 Vict Ch 99 which has been repealed by the 17 & 18 Vict ch 120. Solicitor Customs London. 14th June 1858. The whole of the expenses were incurred in getting possession of the Tallow, - or rather its representative It had been sold to Mr Yates of Beverley who had melted it down with other Tallow. I therefore called upon him to deposit with me £15 " 15 " 0 as its substitute which he did. On the 8th instant I returned him that amount by an Order from the Board of Trade. Messrs Catchpole & Davis are entitled to the whole of the merit of tracing out the Delinquents in this case - viz - Smith and others - and also in the case of Parker and others - annexed to paper No 6039. - There was not any Informer, - such as contemplated by section 451 M S Act 1854 - Some Tallow had been brought into Hull by some Fishing Boats which had been picked up at sea. That circumstance led them to enquire of Tallow Chandlers and others in Town engaged in the Tallow trade, and the result of those enquiries enabled them through their own diligence alone to have the Wreckers in question who had so greatly violated the Law. -----

Board of Trade Marine Dept. No 10978 Registered 30th Oct 1856 Refd to Mr Farrer Capt Robertson The Collectors of Customs Hull is requested to report on this case 30/10/56 T. H. Farr Sec. M. Dept Bd Trade, London. From the Quantity of Iron recovered from the wreck of the "Branford" - as near as can be ascertained it is estimated that about forty Tons remain with the Vessel, - When the Vessel was swept for the purpose of obtaining Specimens to produce in Court at the Trial before the Recorder, - and which operation occupied considerable time, I deemed it adviseable - to have a Buoy placed over her. - in the event of a further quantity being required, - for which purpose I borrowed the Buoy in question from the Trinity Department in this Town The object of which the Buoy was borrowed having been attained, - so far as the trial is concerned whether it will be allowed to remain any longer where it is, - Mr Rutherford of Worksop in Nottinghamshire claims to be the owner of Iron, - and his application on the subject - I am informed is before you, - The Board of Trade being at present - constructively the Owners, l and whether on shore grounds You may desire the spot to be marked is also for consideration JS.

Constable to Wreck in the Manor of Holderness I shall feel obliged if You will inform me of the sea limits of that Manor I am Sir Your obt Servt T A Gardner Col & Recd Hull pro J.O Dowd Sol for M. S. D 1/4 Solicitor This boundry includes the whole of the parish of Burniston, - The Dyke or Beck is a short distance south of Graysthorpe "See" Bryants Map of the East Riding of Yorkshire 1824 1828" and "Lewis" Topography 1845" From the said Dyke or Beck the limits extend South to Spurn point including the whole of the Coast except from the Northern Boundry of Hornsea, - which adjoins Atwick, - south to where the waters of Hornsea Mere are discharged into the Sea by a Stream from that Mere an extent of about two miles, - the manor of which is claimed by Mr Bethell of Rise, - See my letter to the Board of Trade dated 4th January Inst Holderness then extended from Spurn Point, - up the Humber to the River Hull, - The whole can be traced on Bryants Map before mentioned JS
