Executive Department Nashville Feby 7th 1842

Gentlemen of the Senate I have the honour to acknow ledge the receipt of your [illegible] of this morning by the hands of your clerk Wm Lane; in which you notify me that the [illegible] of Lenders of the Bank of Tennessee made to the General Assembly on the 28th [illegible] have been recucled by the Senate. As the Executive of the State it was my duty to nominate [illegible] persons to serve as Directors of the Bank of Tennessee; I have [illegible] to discharge this duty in such a manner as to protect the interest of the state; and as far as I could discern to the different [illegible] of Society a just and pair representatives in the disection and management of an Institution in which they have a common interest; in the final [illegible] of which there is an equal liability and in the advan tages and benefits of which they have an equal rights to participate. How far I may have succeeded in accom plishing this purposes it does not become me to say I cheerfully [illegible] its [illegible] to the [illegible] of our common constituents from whos determinations then can [illegible] appeal. I might here content myself by chasing this communication; but if the duty of appointing [illegible] for the [illegible] which is as obligatory on the Legislature as the Executive is to be disregarded; and the plain agreements of this law

are to be set at [illegible] and continued; I deem that then shall be no [illegible] as to when the responsibility shall rest. You have seem pleased to delay your action on this [illegible] within a few hours of the probable close of your session and although I might have desired a greater length of time, to have matured my action on a subject of so much importance to the County and responsibility to myself state I do not find enough in these circumstances [illegible] as they may be to absolve my from the prompt and faithful disch arge of my duty. I have with transmit the names of tardee persons to serve as Directors of the Bank of Tennessee for the [illegible] two years.
