To all to whom these presents shall come Thomas
Potter Macqueen of Ridgmont in the County of Bedford Esquire John
Mac Arthur of Camden in the Colony of New South Wales Esquire and Thomas
Icely of the Colony of New South Wales Esquire severally Send Greeting
Whereas the said Thomas Potter Macqueen some time in or about the year one
thousand eight hundred and twenty five by John Mac Arthur Esquire of the Colony
of New South Wales aforesaid lent and advanced to John Campbell then of the said
Colony of New South Wales aforesaid Esquire (but since deceased) the principal sum
of Eight hundred pounds Sterling the repayment whereof with interest at Eight
pounds per cent per Annum was secured to the said John Mac Arthur as the
Trustee of the said Thomas Potter Macqueen upon Mortgage of a certain Estate
belonging to the said John Campbell situate in New South Wales aforesaid and
called or known by the name or description of the Boon-Garibee [Bungarribee] Estate in the
said Mortgage Security particularly mentioned and described And Whereas the
said John Campbell hath since departed this life and his Trustees or Executors
shortly after his decease caused the said Estate so on Mortgage to the said
John Mac Arthur as Trustee as aforesaid to be sold whereupon the above
named Thomas Icely became the purchaser thereof subject to the said
mortgage and the principal money and Interest thereby secured and made
payable And Whereas the said principal sum of Eight hundred pounds
so advanced to the said John Campbell was the sole and absolute property
of the said Thomas Potter Macqueen and was lent and advanced by the
said John Mac Arthur as the Trustee of the said Thomas Potter Macqueen
and by and with the privity consent and direction of the said Thomas Potter
Macqueen and the name of the said John Mac Arthur as the person
lending or advancing the same was inserted in the said Mortgage Security as
the substitute only for the said Thomas Potter Macqueen And Whereas there
was on the twenty second day of February one thousand eight hundred and
thirty due and owing to the said Thomas Potter Macqueen upon the Security
of the said hereinbefore mentioned Mortgage Security for principal and
Interest the sum of one thousand one hundred and seventeen pounds four shillings and five pence
And Whereas the sum of one hundred and two pounds fourteen shillings
part of the said sum of one thousand one hundred and seventeen pounds four shillings and five pence
was paid to the said John Mac Arthur on account of the said
Thomas Potter Macqueen by the executors and Trustees of the said John
Campbell some time towards the end of the year one thousand eight
hundred and twenty nine And Whereas it was agreed that one thousand
pounds other part of the said Sum of one thousand one hundred and seventeen pounds
four shillings and five pence should remain and be secured on Mortgage to the
said John Mac Arthur by the said Thomas Icely the said purchaser of
