Kearns said "No Corporal it is me" I asked why
he did so I dont recollect what answer he made
I would not swear from my own knowledge who
fired - I saw the blacks rising up after the shots
were fired - I cant say what number of blacks
were there saw no Boomerang or spears thrown
did not see any men rising from the camp who
threw a Boomerang could not say whether any
one was wounded Cant tell who were in the
right & who in the left division
X ex'd Parker It was after the shots fired [insert] I told Mr Cameron - I did not tell Mr
Cameron I heard it & told him that Kearns told
me - Mr C said that none of the party should
fire until he gave the word of command -
By [Nul?] Court Ensign Cameron recalled - on being [insert] here asked if
Corporal Mullins had told him that Kearns had
fired - He admitted that Mullins had done so
I then asked him if he did not consider that
admission was sufficient to satisfy him in
putting Kearns on trial before a Court Martial
for having fired contrary to the orders of his Commanding
Officer - Mr Cameron said he did not suppose
the evidence sufficient as there was not evidence
of any person who had seen him in the act
of firing - I told him he was greatly in
[...] for so supposing for a free and voluntary
admission or confession of guilt was legally
admissable evidence - and I intimated that if
upon that evidence Kearns had been put upon
his trial before a Court Martial - the interference
of the Civil Tribunal of the Country might have
