Statement of W Frank Walker
Policeman for city of Laurens
Jan the 28th 1909
last night about 2 oclock Mr Stone and
myself went down RR track towards
water tank we pait train from
Spatinburg i got off on right side Stone
on left side about two minuts after
train came in heard four shots Mr Stone
cald me i answerd what for are you shot
no come to me imediately four more shots
Stone says come quick i shot all to peases
come quick i crawled under the car to him
when i got to him he was by side of car
and on top of a man it was dark i could
only see the bulk of stone I could for
a light Captain Sturt Conductor came i
asked a Surender he the man says i give
up i ask the second time drop your
pistol imediatly he turned on me
and shot at me then i shot 5 times at
my first shot the light went out and
i shot in the dark the man shot at me
with left hand as he was loding
his pistol Chief Bagwell and Maor Babb
took his tolld off ov his person censisting

pistol of 45 caliber mag a seen
when i told him to frop his pistol
he did not do it i told him if he did
not i woud shoot him he said he
would drop it i told conductor Sturt
to get get it Sturt craled under the
box car to get it and insted of him giving
Sturt the pistol he shot at me then
i shot the 5 times all the policman
are instructed to look after any one
they see after 12 oclock at night
