The Council resumed.

The Committee rose, reported progress and asked leave to sit again - The Report was received.

Ald: Drennan introduced a By Law relating to the penalties &c for the breach of By Laws passed before the fifteenth day of August A.D 1866 and now in force - which was read a first time.

Ordered, That the 29 Rule be suspended and the Council go into Committee of the whole on the second reading.

Ald: Metcalfe in the Chair.

The Council resumed.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause - the Report was received.

The By Law was read a thrid time and passed.

Aldermen Gildersleeve and Pense here entered.

Ald: Gaskin introduced a "By Law respecting the sale of Potatoes, Turnips, Carrots, Parsnips, Beets, Onions, Peas, Beans, Oats and Berries in the public Market City of Kingston" which was read a first time.

Ordered, That the 29th Rule be suspended and the Council go into Committee of the whole on the second reading.

The By Law was read a third time and passed.

Ald: McRossie introduced a By Law respecting Streets which was read a first time.

The Committee rose and the Chairman reported the second reading of the By Law clause by clause as amended - The Report was received.

The By Law was read a third time and passed.

A Communication from James F. Earl Esquire Reeve of Elgin was read complaining of the state of a portion of the Kingston and Phillipsville Road.

referred to the Finance Committee - they to take the opinion of the City Solicitor and report at the next meeting of this Council.

A Communication from Messrs Kirkpatrick and Rogers was read informing the Council that the late John Walkins by his Will bequeathed to the Corporation of the City of Kingston the sum of $900 to be invested and the Annual interest or income arising thereforein to be applied for the use and benefit of the inmates of the House of Industry in this City.

On motion of Ald: McCammon seconded by Ald: Carson Ordered, that the Communication of Messrs Kirkpatrick and Rogers be referred to the Finance Committee to report.

Ald: Metcalfe brought up the petition of William Davis and 16 others praying the Council to use its influence with the Police Commissioners to have Cab stand changed.

On motion of Ald: Metcalfe seconded by Ald: Pense On motion of Ald: Ordered, That the petition of Miles Sennott and others Licensed Cabmen be referred to the Committee on Licenses to report at next meeting of this Council.

On motion of Ald. Drennan seconded by Ald. Clements Ordered, That the question of back taxes for 1874 of the Ontario Locomotive Works be referred to the Committee on Finance to report.

On motion the Council adjourned.

Thursday 7:30 O'Clock P.M. Kingston April 26th 1877

A Meeting of the Council of Corporation of the City of Kingston was held this day in lieu of the Regular meeting day. Present.

His Worship the mayor

Aldermen Asselstine, Carson, Drennan, Dupuis, Gaskin, Metcalfe, Mooers, McCammon, McDermott, McRossie, Pense, Power, Walkem

The Clerk read the Minutes of the three last meetings.

A Communication from Mr Peter Keil Fishery Overseer was read on the state of the Fish Market &c.

On motion of Ald: Drennan seconded by Ald: Dupuis Ordered, That the Communication of Peter Keil Inspector of Fisheries be referred to the Committee on the Market to take prompt action on the same and report next meeting of the Council.

A Communication from Thomas Conley License Inpector &c was read applying for the office at present used as City Register office for the License Commissioners.

On motion of Ald: Carson seconded by Ald: Drennan Ordered, That the Communication of the License Commissioners be referred to the Committee on City Property to report.

A Communication from William Martin was read withdrawing his proposition made in his letter after the fire in June last with respect to the opening up of Montreal street. x

[margin] x On motion of Ald: Dupuis seconded by Ald: Metcalfe Ordered, That Ald: Prices resolution of 12th of March be reconsidered only as far as the same applies to the opening up of Montreal and Division streets as resolved in the motion of Ald: McRossie of April 26th and the sum of $500 be appropriated for Montreal street our $500 for Division street - one thousand dollars in all. [/margin]

On motion of Ald: McRossie seconded by Ald: Carson

Whereas some weeks must yet elapse before by the provisions of the Statute the Arbitration as to the value of the right of way for the extension of Montreal street to Brock street and Division street from Johnston to David street can be held

And Whereas the Council is to furnish half the cost of the opening thereof

And Whereas the Council has adopted the reports of the Streets Committee recommending that said street with Division street should be proceeded with

And Whereas in justice the property owners who have built on the lines of Montreal street as established in the By Law to open the same and also in justice to their tenants no further delay should take place in making the said streets

Be it therefore Resolved that the Streets Committee be and it is hereby authorized to proceed to make the said Montreal and Division street to the extent in the mean time of the Councils contribution to the cost thereof and that the

arbitration be proceeded with as soon as possible - not exceeding five hundred dollars in each case until further appropriation is made by Council.

A Communication from the Reverend T.A. Parnell was read respecting Taxes - There was no action taken therein

Ald: Carson brought up the petition of George M. Wilkinson praying for the extension of a drain in Williamsville.

On motion of Ald: Carson seconded by Ald: Asselstine Ordered, That the petition of George M. Wilkinson be referred to the Committee on Streets to report.

Ald: Drennan brought up the petition of Messrs Fraser and George and 116 others praying the Council to cause the business portions of the streets of the City to be regularly sprinkled.

Ald: Drennan moves seconded by Ald: Dupuis That the petition of Fraser and George and others be referred to the Committee on Fire, Water and Gas with power to act, and take prompt action on the same it being understood that the amount of money be paid by the City until an appropriation be made for the same.

In amendment

Ald: McRossie moves seconded by Ald: Walkem That the petition of Fraser and George and others be referred to the Committee on Fire, Water and Gas to report which being put was lost Yeas 5 Nays 8 and the original motion being put was carried Yeas 8 Nays 5

Ald: Pense brought up the petition of Benjamin Chambers praying the City's portion of payment for a drain made in Frontenac Ward last year.

On motion of Ald: Pense seconded by Ald: McCammon Ordered, That the petition of Benjamin Chambers be referred to the Committee on Streets and Improvements to report.

Ald: McDermott brought up the petition of the Alpha Hose Company praying they be furnished with Helmets [Garments?] at Fires.

On motion of Ald: McDermott seconded by Ald: McCammon Ordered, That the petition of the Alpha Hose Company be referred to the Committee on Fire, Water and Gas to report.

Ald: Metcalfe brought up the petitions of Francis Jeffers, Francis McGuinness, Francis McCambridge and James Sevards. respecting Taxes.

On motion of Ald: Metcalfe seconded by Ald: Pense Ordered, That the petitions of Francis Jeffers, Francis McGuiness, Francis McCambridge and James Sevards respecting Taxes be referred to the Finance Committee to report.

Ald: Drennan from the Committee On Finance and accounts brought up a Report (Number 558 Book D) which was read.

Ald: Drennan moves seconded by Ald: Dupuis That the report of the Committee on Finance be received and adopted.

In Amendment

Ald: Gaskin moves seconded by Ald: Mooers That the portion of Finance report which refers to granting a certain sum of money to Policeman Stacey be struck out, for the reason that it would be unwise seeing the state of our finances at present also establishing a bad precedent - which being put was lost Yeas Aldermen Asselstine, Carson, Gaskin, Mooers, Power 5 Nays Aldermen Drennan, Dupuis, Metcalfe, McCammon, McDermott, McRossie, Pense, Walkem 8 and the original motion being put was carried Yeas Ald. The Chiarman from the Committe on Fire, Water and Gas brought up a Report (Number 559 Book D) which was read and adopted.

The Chairman from the Committee on the Market brought up a Report (Number 560 Book D) which was read

On motion of Ald: Carson seconed by Ald: Gaskin Ordered, That the report of the Committee on the Market be received and adopted - it being understood that no money be expended until an appropriation has been made for the purpose.

On motion the council adjourned
