W. Robinson, Ryan, Stewart, Tait, Taylor, Toye, Walkem, Wright - 21.

Nays: none.

Ald Carson introduced "A By law entitled A By Law to amend By Law
No 462 entitled "A By Law respecting Wooden Buildings &c which was read a
first time.

The 30th Rule was suspended and the Council went into Committee of the
whole on the second reading.

Ald Stewart in the chair.

The Council resumed.

The Committee rose and the Chairman reported the second reading of the By
Law clause by clause - The Report was received.

The By Law was read a third time and passed.

Ald Donnelly Chairman of the Elevator Committee brought up Report
which was read.

Ald Donnelly moves seconded by Ald Carson
That the Report of the Elevator Committee be received and adopted and the
Committee proceed to carry out its recommendations.

In amendment.

Ald McKelvey moves seconded by Ald Allen
That the Report of the Elevator Committee be taken up clause by clause which
being put was carried and the original motion was lost.

On motion of Ald Donnelly seconded by Ald Elliott
Ordered, That the first clause changing 90,000 to 100,000 pass.

Ald McKelvey moves seconded by Ald Richardson
That clause one be amended by ninety 100,000 instead of 90,000
exclusive of site which being put was lost.

On motion of Ald Donnelly Seconded by Ald Elliott
Ordered, That clause 2 be amended by naming as a committee on the part
of the City, the City Engineer, Chairman of Elevator Committee and two Aldermen be
named by this Council.

On motion of Ald McKelvey seconded by Ald Allen
Ordered, That clause IV be amended by adding the words between
West Street and Cataraqui Bridge.

Ald Ryan moves Seconded by Ald McKelvey
That the penalty shall be $20.00 per day.

On motion of Ald Kent Seconded by Ald Allen
Ordered that in view of the fact that Mr Mooers is prevented at
present in presenting a proper stock sheet it is understood and agreed that
he shall deposit with the City of Kingston on the signing of the agreement a
marked cheque or deposit receipt of a Chartered Bank for the sum of $5000.00
as a forfeit that the terms and conditions of the agreement with the City shall
be fulfilled and carried out and said cheque or deposit Receipt be returned
to Mr. Mooers when $5000.00 is expended in construction of Elevator is completed
as certified by Committee.

On motion of Ald Donnelly seconded by Ald Walkem
Ordered that the Report as amended be adopted and the Committee
proceed to carry out its recommendations.
