Dear Sir,

The above diagram represents the location of my lot at Mt. Auburn ~

The facts in the case are these - viz

I was an original & early subscriber but did not locate my lot until I think in 1843 or 4 - -

I relocated the lot marked C on the west side of the Lawrence lot - the next one was taken by Mr. Abbot Lawrence for the Bigelow family - the lot contained 500 sq. feet & I paid the^money [from?] to the Trustees & took a Deed - Some months afterward Mr. L. & myself were notified that the Trustees had determined not to locate any lots on the west side of the Lawrence ^lot being desirous of enlarging the area in front ^of the church - we then changed our location to the North side of the Lawrence lot (see above), - A year or two after this Mr. Amos Lawrence being desirous of

enlarging the Family lot by extending it to the Church avenue, wrote me a note asking if I would consent to relinquish my lot, to which I assented & reconveyed it, receiving from the Treasurer the certificate which I now hold authorizing a location elsewhere of 500 sq. feet as an original subscriber - - - An arrangement was subsequently made (when I was absent at the South) to locate us where we were at first & Mr. Abbot Lawrence, in order to settle the matter, took the deed from my lot in his name & afterward offered it to me; He paid for the lot, not knowing that I had a certificate of having already paid for it, & for the same number of sq. feet.

Now what I ask of the Trustees is to restore me the lot that I selected & paid for - 5 or 6 years ago, to accomplish which it will be necessary to reimburse Mr. Lawrence & with Interest if he requires it, for as it now stands, the Trustees have been paid twice for the same lot.

The Communitee on Lots, to whom the appli^ cation of Mr Eb. Chadwick was referred with full power to act &c - have examined the Subject & find the facts in relation to it are accurately stated in the p'ceeding communication, from which it appears that Mr Chadwick brought & paid a lot on the West side of the Lawrence Lot he afterwards resigned, by the request tees - The same lot was [afterwards?] again assigned to Mr Chadwick, but in his absence, it was paid for by Mr Lawrence & the deed agreed in his name. - Mr Lawrence is willing to convey the Lot to Mr Chadwick on being reimbursed to the account he paid (with interest) -

The Commee consider it to be the duty of the Trustees to do this, & therefore, they hereby direct the Treasurer to pay to Abbot Lawrence Esq. the amount paid by him for Lot 1356, (with interest if demanded by him) on his transferring said Lot to Eben Chadwick Esq ~
