The comee to whom was referred the subject of the bequest of the late Mr. Justice Story by leave respectfully to report that the nature of the trusts upon which the bequest was made, in their opinion requires a separate account to be kept of the income & expenditures of this fund; but pursuant to a regulation made by the Trustees on the there can be no separate investment of it. That regulation was as follows

We do not perceive any good reason why it should be accepted from in this instance. The donor was himself one of the persons by whom the regulation was made & having made a bequest which comes within its terms & spirit must be taken to have made the bequest subject to the regulation. At the same time we should think it proper to give notice, to the Executors of Mr Justice Story, of the regulation & how the income of the funds will be ascertained. We have subjoined certain votes which we think should be passed.

Voted. That the Treasurer open an account on his books with "The Story Fund" - crediting that account

from time to time with all sums receivable from the income of the money bequeathed by Mr Justice Story to the corporation in trust & invested pursuant to the regulation proposed by the Trustees on the . & charging that account with the amount reported bythe Superintendent as expenses of thecare of the Lot & Votedpursuant to the vote next following & that any surplus of such income be added to the principal & kept invested.

That the Superintendant be directed to keep the lot (No 313) which belonged to the late Mr Justice Story in good condition & repair & to keep the said Monument & the iron fence about the same in good condition & repair & to keep the said lot suitably turfed with suitable shrubs & flowers & trees in & about the same, until the further order of the board; & that he report the expense thereof annually to the Treasurer.

Voted That the Sec'y communicate to the Executors of the Late Mr Justice Story a copy of the above report & votes & a copy the regulations referred to therein.
