Office of Indian Affairs San Francisco. Cal Dec 12th 1864

Sir, Enclosed please find letter from T. J. Henley relative to property accounts. In accordance with your instructions dated June 18th 1864 in relation to property in the handle of T. J. Henley. I called on him for the property producing my authority in the premises. He asked for time (to the 1st of October) which was granted. I then made another demand when he reported that he was completing his arrangements for the delivery and would be ready by 10th of November (after the election) This also was granted. Nothing having been done up to the 15th of November. I notified him that I should report on the 12th inst (today) that I had complied with my instructions and no property could be obtained. He then offered me the bond of S. J. Hensley in whose hands the cattle are said to be to deliver to me at a certain time and place; a certain number of cattle. This would be perfectly good and I agreed to accept it and report

accordingly. The proposition was finally modified by Henley so as to amount to nothing but a verbal agreement when all negotiations ceased. Mr Henley admits that some of the cattle are in his hands but whether he intends to turn them over or not is more than I have been able to accertain.

The receipts mentioned in Henley's letter are received but will be retained until my final report. I have thought it advisable to give him time with the return of Davis as I am determined he shall have no excuse in future for not settling his accounts. He has notice that I stand ready to receive any or all the property mentioned in your letter at any time or place he may name in this State. He shall have no occasion to regret his inability to find an authorized Agent to receive the property in his charge while the matter is in my hands.
