NORTH CAROLINA ALAMANCE COUNTY

KNOW ALL MEN BY THESE PRESENTS, that we, Ethel G. Harris, Widow, Edward Guthrie (brother), Erwin G. Harris (son) and wife, Zuma H. Harris, and Sarah L. Harris, (daughter), of Alamance County, North Carolina, parties of the first part, in consideration of Ten Dollars ($10.00), paid to us by J. W. Coltrane, of Guilford County, North Carolina, Party of the second part, the receipt whereof is hereby acknowledged, for ourselves, our heirs, executors, and administrators, agree to sell and convey to said J. W. Coltrane, or his assigns, for the consideration of SEVENTEEN THOUSAND DOLLARS AND NO/100 ($17,000.00), the following described property.

A certain lot of land, lying and being in Burlington Township, Alamance County, North Carolina, and more particularly described as follows:

BEGINNING at an iron bolt, corner with Church Street, and William Burke, running thence with line of William Burke N. 35 deg. W. 374 feet to an iron bolt, corner with James H. Holt; running thence with line of James H. Holt, S. 86 deg. E. 68 feet to an iron bolt, corner with Mebane Real Estate and Trust Company; running thence with lines of Mebane Real Estate and Trust Company and E. L. Morgan S. 35 deg. E. 323 feet to an iron bolt corner with Church Street; running thence with line of Church Street S. 55-2/3 deg. W. 55 feet to the BEGINNING.

A certain lot or parcel of land lying and being in the City of Burlington, in Alamance County, North Carolina, adjoining the lands at this or some future time of E. G. Guthrie, G. A. Burke, J. Samet a l a 15 foot alley and described as follows:

BEGINNING at an iron bar on said 15 foot alley, in the line of E. G. Guthrie, and running thence with said E. G. Guthrie S., 35 deg. E. 133 feet to an iron bolt, corner with G. A. Burke; thence with line of said G. A. Burke N. 55-2/3 deg. E. 60 feet to an iron bolt in line of J. Samet; thence with line of said Samet N., 35 deg. W. 92 feet to an iron bolt in said 15 foot alley thence with said Alley N. 86 deg. W. 89 feet to the beginning and being the same that was conveyed to party of the first part by Mebane Real Estate & Trust company by deed recorded in Book 76 at page 91

The cost to be paid by the said J. W. Coltrane, or his assigns shall have the sum of SEVENTEEN THOUSAND DOLLARS ($17,000.00) $3000.00 of which is to be paid as soon as an abstract of the property can be made and re-zoned The City of Burlington has agreed to re-zone said property for business purposes. This option may be accepted by the said J. W. Coltrane, or his assigns, as of January 15, 1953, in the event, the title check proves to be satisfactory and the property is re-zoned. Conveyance then shall be made on January 15, 1953, by a warranty deed conveying a clear title free from all encumbrances All tenders and deliveries here under shall be made at the office of W. L. Shoffner, Attorney of Burlington, North Carolina.

It is agreed that if the said J. W. Coltrane, or his assigns shall fail to accept this option on January 15, 1953, or shall after said acceptance fail to pay the balance due thereon on the purchase price, which sum shall be $14,000.00, the cost above mentioned, being the $10.00 and the $3,000.00 payments, at the time and place, and in accordance with the terms and conditions hereinbefore mentioned, the said J. W. Coltrane or his assigns, shall forfeit the said payments of $10.00 and $3,000.00.

Ethel G. Harris, one of the grantors, above named shall have the privilege of using the $3,000.00 above mentioned between now and January 15, 1953, for the purpose of building a new home. The deed to the said J. W. Coltrane shall be executed, and delivered to the said W. L. Shoffner, as soon as he has completed the abstract, and the same shall be held by him in escrow until January 15, 1953, at which time he is to deliver said deed to J. W. Coltrane, or his assigns upon the receipt of the balance of the purchase price which shall be $14,000, it being understood that the $3,000.00 above mentioned shall be delivered to the said

W. L. Shoffner as soon as the deed has been executed by all of the parties of the first part who are the present owners of said real property and as soon as the same has been delivered to the said W. L. Shoffner to be held by him in escrow.

I, La Verne May, a Notary Public in and for the aforesaid County and State, do hereby certify that Ethel G. Harris, Edward Guthrey, Edwin G. Harris and wife Zuma H. Harris, and Sara L. Harris, of Alamance County, appeared before me this day and acknowledged the due execution of the Option for the purposes therein expressed.
