MORTGAGE DEED—Printed and for sale at The Davidson Dispatch Office, Lexington, N. C.

State of North Carolina, } Davidson County.

THIS IDENTURE, made this 15th day of January 1898 by and between E. L. Siceloff and Julia C. Siceloff his wife, as parties of the first part, and J. R. Thomas as party of the second part, witnesseth: For that whereas, said parties of the first part are justly indebted to said party of the second part in the sum of ($400.00) Four hundred dollars, as is evidenced by a bond of even date herewith, bearing interest from date at six per cent, per annum, and due and payable on the 15th day of January 1899 and whereas said parties of the first part are anxious to secure the payment of said bond at maturity; Now, therefore, in consideration of the premises, and for the purpose aforesaid, and for the sum of One Dollar, to the parties of the first part, paid by the party of the second part, the receipt of which is hereby acknowledged, said parties of the first have bargained, sold and conveyed unto said party of the second part, his heirs and assigns forever, two certain pieces or tracts of land lying and being in Davidson county, State aforesaid, in Midway Township, adjoining the lands of Philip Siceoff, Daniel Clodfelter and others, and bounded as follows:

Beginning at a Stone, S.10° E.7.36 chs, with John Long to Stone. S78 E. 6 chs White oak. S.7.27 chs to Hickory. E.1.36 chs. Apple tree. S.9.9 chs to a white oak. N.9.12 chs stones W.9.9 chs to a Pine. N.16.9 to Stone. E.24.18 chs with the Auhost Siceloff land to a Hickory: N.28° E.5.92' chs to a Pine: S.62° E.7.75 chs to a Hickory: S.54° E.3.05 chs to a Stone: E.1.98 chs to white oak: E.60 lks to a Black Oak: E.5.08 chs to the beginning containing 124 acres more or less.

Also one other tract beginning at a Stone. N.3.25 chs to Plum Bunch E.20 chs to a Hickory: N. 40° E.17.12 chs to a Black Oak. S.62° E.3.12 chs to a Post Oak. South with Geo. Long line: 13.22 chs to a Hickory: N. 62° W. 7. chs & 7 lks to a Pine; S. 28° W. 5.92 chs to a Hickory W. 24.18 chs to beginning containing 21 acres more or less.

To have and to hold said land and premises to him, said party of the second part, his heirs and assigns forever. And said parties of the first part do covenant to and with said party of the second part, his heirs and assigns: That they are the owners and seized of said premises in fee-simple; That they have the right to convey the same; That the same are free from any incumbrances whatsoever, and that they will forever warrant and defend the title to the same from the lawful claim of all persons whatsoever.

But this Deed is Made on This Special Trust: That if said parties of the first part shall well and truly pay to said party of the second part or his legal representatives, the bond hereinbefore described as its maturity, then this deed to be null and void.

But if default shall be made in the payment of said bond or interest on same, or any part of either at maturity, then and in that event it shall be lawful for and the duty of said party of the second part, his heirs, executors, administrators or assigns to sell said land hereinbefore described to the highest bidder for cash, at the court house door in Lexington, in Davidson county, first advertising the same for thirty days at the court house door, and four other public places in Davidson county, or in some newspaper in said county, and convey the same to the purchaser in fee-simple, and out of the money arising from said sale to pay said bond and interest on the same, to-gether with their cost of sale and pay the surplus (if any) to said parties of the first part or their legal representatives.

In testimony whereof said parties of the first part hereunto subscribe their names and affix their several seals.

I, W. H. Walker Deputy Clerk of the Superior Court, do hereby certify that E. L. Siceloff and Julia C. Siceloff his wife appeared before me this day and acknowledged the due execution of the annexed deed of conveyance; and the said Julia C. Siceloff being by me privately examined, sepaarate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband, or any person, and that she doth still voluntarily assent thereto.

Let the same with this certificate be registered.

Witness my hand this 15 day of Jan. 1898. W. H. Walker Deputy Clerk Superior Court.

I, [blank] Justice of the Peace, do hereby certify that [blank] and [blank] his wife, personally appeared before me this day and acknowledged the due execution of the within deed of conveyance; and the said [blank] being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband or any other person, and that she doth still voluntarily assent thereto.
