that eventthe Market House Company agrees (a) at its own expense to build commomius and suitable market house, 100 by 152 feet, of brick, concrete or stone, walls 22 inches thick, on the property now owned by said Company., and (b) to give the City of Fort Worth Texas an option for five years from the date of acceptance of this agreement in which to purchase from the Market House Company the property and building or buildings then owned by it at such value as the City, thru its Council, and the Market House Company, thru its Board of Directors, may agree., or, in case of failure to agree, at such amount as may be fixed by the Board of Equalization of Fort Worth, or as maybe determined upon in any manner hereafter between the parties., provided always that the deed, from the Market House Company to the City of Fort Worth shall contain the following express provisions: First, that the land and improvements thereon, tobe conveyed by the Market House Company to the City, shall be used forever, as a public square and Market House., and, second, that any organization, or individual, or individuals who shall desire shall have the right to construct, erect and maintain an auditorium over said Market House at any time without any ground rent or expense, other than an obligation to maintain and keep in repair said auditorium.

Dear Sir:-

At the request of your Committee, we have secured options on the following properties, for Market Square purposes:

Mrs. C. J. Gambrell, 78 1/2 x 125', without improvements $7500.00
Mrs. N. F. Flanner, 75 x 125', " " 4500.00
W. R. Kirby, 75 x 123' " " 2400.00
G. W. Wallace, 36 x 100' with " 2000.00
Also, we have a proposition from John Kaiser to exchange his 36 x 100', for 30 x 125' known as the Markel property, and 2' off the Flanner property, making 32 x 125', and a difference of $550.00, he to have the improvements on the Markel property and also keep the improvements on his own property.

We have been advised that we can buy the Markel property for $1200.00 and an option has been forwarded to the owner for signature.

We hand you herewith options as above. Also, report from City Attorney E. C. Orrick, advising that the title to the Fort Worth Market Company's property is good.
