To the Honorable Mayor and City Council of the City of Fort Worth.

Gentlemen:

In accordance with your direction for me to take steps to acquire that certain property necessary for the opening of Boid d'arc Street, I have prepared and herewith hand to you deed from August Males to the City of Fort Worth and a deed from the City of Fort Worth to Lloyd Pollock.

In order that this title may be perfect, it is necessary that a release be procured from one J.N. Brooker who holds vendor's lien notes upon said property, which release has been duly prepared and will be duly delivered upon the closure of this transaction when the money is paid.

I will state that I conceive it to be my duty to close the transaction in the form in which I report it.

It will be necessary that the taxes shall be paid and I will submit with my report a statement of taxes for the year 1906 which are not yet due and cannot yet be paid, and it will be proper for the City Council to deduct from the total consideration of $2200 the sum shown in the statements attached hereto for the taxes of 1906.

It will also be proper for the City Council to pass a resolution in connection with this report authorizing and directing that the matter be closed by paying to said August Males the full sum of $2200 upon the delivery of the release of the said J.N. Booker and the payment of the taxes due and the deduction of the taxes for the year 1906 which is simply a matter of calculation as will appear from the statements thereto attached.

It is also proper that the resolution should further provide that the deed as prepared and submitted to be made by the City of Fort Worth to Lloyd Pollock be by the Council directed to be made for and on account

of the considertion named therein.

I attached hereto also my opinion on the abstract of title and submit to the Council the abstract of title itself which has been furnished by the said August Males.

To the Honorable Mayor and City Council, Fort Worth, Texas.

Gentlemen:

I have examined the title to that tract of land in Tarrant County, Texas described as being the south 80 feet of Block W. of Bellvue Hill Addition to the city of Fort Worth, Texas, and find the title well vested in August Males, subject to the following objections to-wit:

The notes mentioned on page 1 of supplemental abstract No. 8851 of the Fort Worth and Tarrant County Land Title Office amounting to $1000 with interest.

The acknowledgment of the wife appears to be defective as shown on pages 1 and 2 conveying the property to August Males and should be cured.

I find the taxes for the year 1905 delinquent and have accrued for 1906 and these taxes should be provided for.

It would be well to have the city engineer to locate the property upon the ground and see that the actual amount of property bought is actually located upon the ground so that same can be held by the city.
