Fort Worth, Texas, September 1st, 1903.
To the Honorable City Council of the City of Fort Worth, Texas:
Gentlemen:
Whereas a certain Ordinance was passed by your Honorable Body on, to-wit: The 18th day of April, 1902 being Ordinance No. 839, and styled, "An Ordinance to regulate the width of sidewalks, and locations of curb-lines upon Homphill Street, south of Magnolia Street." Said Ordinance, as shown by the records, having been passed under suspension of the rules, and was never officially approved by the Mayor, and
Whereas said Ordinance, if forced enforced and complied with, tends to, and in fact would injure and financially impair the value of all property fronting on said street, by reason of the fact that said street, instead of being the beautiful driving Avenue that it is now; would be, since the construction of the Rapid-Transit Line thereon, practically an alley, unfit for driving purposes, with an unnecessary space of twenty feet left on each side, and,
Whereas said Street was originally designed for an eighty foot unknown word driving street, as shown by the records, and was graded and graveled by the property owners fronting thereon, with their own funds and at their own expense, before the Eighth Ward was annexed to the City of Fort Worth, and
Whereas a street car line is now being operated and run on said street, to the south line of the City, which was not the case when your Honorable Body saw fit to pass the aforesaid Ordinance, and,
Whereas very few of the property owners on said street, were in favor of having the width or curb-line of said street disturbed or changed, and realizing that reducing the width of said street, as proposed by said ordinance, would in fact reduce the value of the property fronting thereon, making driving on said street hazardous and dangerous, and practically making hitching horses along said car line on said street impossible,
T H E F O R E, we, the undersigned citizens of the City of Fort Worth and property owners on said Hemphill Street, south of Magnolia Street, hereby petition your Honorable Body to Repeal the aforesaid Ordinance, and cause any and all obstructions heretofore placed in said street, according to its original width, to be removed therefrom, and that the curb-lines and width of said street heretofore recognized, be and remain as originally contemplated and indicated to the public.
