Peter Shriner v. Peter Boyer, 1810

Peter Boyer accused Peter Shriner of trespassing on his property by breaking and entering into the tobacco house and stealing tobacco. Taney defended Shriner. He maintained that at the time of the alleged robbery the land known as The Resurvey (where the Tobacco house was situated) in fact was his property and he had the right to act as he did.

Peter Shriner} ----- advs. -----} - Peter Boyer }

And the said Peter Shriner by R.B. Taney, his Attorney, comes and defends the force and injury when and so forth and saith he is not guilty of the Trespass aforesaid as he the said Peter Boyer above against him complains and of this he puts himself upon the County and so forth and the said Peter Boyer in like manner and so forth -- And the said Peter Shriner by leave of the Court here and according to the form of the Statute in such case make and provided, further defends the force and injury when and so forth as to the coming with force and arms on whatever is against the peace of the State of Maryland, saith he is not thereof guilty and of this he puts himself upon the county and so forth and the said Peter Boyer in like manner and so forth -- And as to the residue of the trespass in the declaration aforesaid above supposed to the done, the said Peter Shriner, saith, that the aforesaid Peter Boyer his action aforesaid thereof against him to have or maintain ought not, because he saith, that the place in which it is supposed the trespass aforesaid was done, is and at the said time in which and so forth was one close of land, with the appurtenances, called The Resurvey on cold Friday in the county aforesaid which said close with the appurtenances is and at the said time in which and so forth was the proper soil and freehold of the said Peter Shriner wherefore the said Peter Shriner at the said time in which and so forth that close, so the people close and soil and freehold of him the said Peter Shriner broke and entered and the tobacco House thereon erected did enter and the Tobacoo therein contained, to wit ten thousand pounds weight did take and carry and throw out of the said Tobacco House and the same did destroy as being on the proper soil and freehold of him the said Peter Shriner --, as it was lawful for him so to do and this he is ready to verify; wherefore he prays Judgement if the said Peter Boyer his action aforesaid thereof against him to have on maintain ought and so forth --
