a few days afterwards. I therefore demanded the £5 from
Statters which he had not accounted and have im-
pounded the same. On the 8th inst I proceeded against
Danby and his four partners, - under the 450th Section
of the M S Act 1854 in respect of the said Tallow before
the Magistrates at Leaven, - who convicted each as follows - viz -

Costs --" 17. 2

Danby immediately paid £6. - " - and was liberated.
and the other four men - not having any goods whereon
to levy distress without ruin to those who have families
they were each committed to the House of Correction
without hard Labour ---for the space of six weeks unless
the Penalty and costs as aforesaid were sooner paid.

Mr Foster Junr attended at Leaven on the 8th instant
which is 14 miles from hence, and gave evidence in the
case. -- Messrs Foster - Therefore ---- as all parties con-
-cerned in commission of the offence have been convicted request that
the £11 " 10.0 which they deposited with me to represent
the said Tallow, - may be returned. From the ready manner
in which Messrs Foster came forward and afforded every
explanation in their power of the matter - their application
appears to me - to merit a favorable consideration.
