work and material shall be Forty Six Thousand, nine
hundred and thriteen and 7/100 dollars($46.913.07), subject to
additions and deductions as herein before provided,and that said
sum shall be paid in current funds by the owner to the
contractor in installments as follows;
Upon estimates issued
byt the architect about once a month as long as the
work progresses. Said estimates to call for payment
in accordance with the state law governing public
buildings , provided however, provided however that
nothing in this contract shall be construed to
create an obligation or incur a liability against
the Ohio University or the State in excess of the
appropriation made for the Normal School of the
Ohio Universty for construction during the years of
1902 and 1903
Payments shall be made on all
suitable materials furnished and delivered at the
building site less fifty per cent; provided, always,
that all material delievered on the grounds
and on which estimates have been based , is to
become the property of the Ohio University ,and
cannot be removed from the premices ,and said
fifty per cent to be reserved until said material
is in palce in the building; and alos payments
on the materials and work in place to be
retained until the building shall have been
completed and accepted by the party of of the second
part. The final and all other payments shall be made
upon the written estimates of the architect to the
effect that such payments are due, and shall be
subject to the terms contained in the resolution of said
Board of Trustees of even date herewith hereto attached
marked Exhibit "A" and made a part of this contract.
If any time there should be any
evidence of any lien or claim for which if established
the owner of the said premises might become liable
and which is chargeable to the contractor, the owner shall
