On or before the first day of January 1856, I promise to pay
to George Dougharty or order four hundred dollars. [It] being the
balance of the consideration of twelve hundred dollars. Which
sum I agree to pay to the said George Dougharty or to his heirs for
a certain negro man named Gibson sold to me this day
with the intent and meaning that on the full payment of the
said sum of twelve hundred dollars to me or to any [of] my heirs, the
said negro man shall be returned to the said George Dougharty
or to his heirs and the said bill of sale to be void and of no
effect in law or equity.

County of Newton } Before me, John Moore, Clerk of the
County Court of said county, personally
appeared W. H. J. Holmes, who signed the above instrument in
my presence by his making his mark, and acknowledged the same to be
his signature and done for the consideration and purposes therein
stated. {County Seal} To certify which, I hereto sign my name
and affix the seal of my office this, the 9th day of
