The Republic of Texas, County of Jefferson } Know all men by these presents that I, William D. Smith, for and in consideration of the sum of two thousand dollars to me paid in the following manner, to say in a full and final settlement of all accounts and liabilities up to the say about the first day of February 1845. Upon which final settlement it is agreed and understood by the parties that the negroes conveyed in this bill of sale to Malcom S. McAlpin fully pays, discharges, and annuls a certain bond or instrument of writing given by William D. Smith to said McAplin, dated on the 11th day of March 1844, and recorded in the office of the County Clerk on the 4th day of January 1845, Book E, pages 231 and 232. It is also agreed and understood by the parties that the bill of sale refund to from McAlpin to said Smith in the above-named instrument remain good and valid, and by this bill of sale to continue in full force and effect both in law and equity from the date of said

bill of sale as aforesaid by Malcom S. McAlpin. Both parties of the county and republic aforesaid have this day bargained, sold and delivered to the said McAlpin, his heirs, executors, and assigns the following negro slaves for life, to wit: Rhoda, aged about 35 years; Joseph, about 30 years; Little John, about 20 years; Lucy, about 12 years; [and] David, about 8 years. Which said slaves I formerly purchased of said McAlpin and by these presents I do hereby relinquish and quitclaim to said slaves all right, title, interest, and property that I formerly purchased as aforesaid. And for myself, my heirs, executors, and administrators, do forever release and quitclaim to the said Malcom S. McAlpin, his heirs and assigns all right, title and interest to the slaves as above described. In witness whereof, I have hereunto set my hand and scroll for want of a seal this first day of April in the year of our Lord one thousand eight hundred and forty-five. In presence of (Test.) William Armstrong, Isaiah Junker. William D. Smith {Seal}. Personally appeared before the undersigned authority William D. Smith and signed, sealed and delivered the foregoing bill of sale in my possession and acknowledged the same to be his voluntary act and deed for the purposes therein set forth. {Seal} Given under my hand and scroll for want of a seal of office this 1st day of April 1845. Alexander Calder, Clerk, County Court, Jefferson County. I hereby certify the foregoing ot be a true copy of the original bill of sale filed in my office for record on the first day of April 1845. The Republic of Texas, County of Jefferson } Know all men by these presents that I, Malvern S. McAlpin of the county and republic aforesaid, for and in consideration of the sum of three hundred dollars to me in hand paid by William D. Smith of county and republic aforesaid, have this day bargained, sold and delivered to the said William D. Smith, his heirs and assigns a certain male slave named John (alia title John). Which said slave I warrant to be sound in body and mind and a slave for life. To have and to hold said slave John as above-described unto the said William D. Smith and his heirs and assigns. I bind myself, my heirs, executors, and administrators to warrant and forever defend the right and title to the said Smith, his heirs, etc. However, it is agreed and understood by the respective parties that, whereas the said McAlpin on the 5th day of February 1845 executed his promissory note to William D. Smith, payable twelve months after date, for the sum of three hundred dollars and fifty-nine cents, [and] bearing ten percent interest from date. Now, the parties agree that the hire of the boy John, as aforesaid now in possession of said Smith, [is] from the date aforesaid

for the term of twelve months [and] is worth one hundred and twenty dollars. On which said amount of hire, whatever is due at the expiration of said twelve months, at which time said note falls, there is then to be interest on said note. Now, if the said McAlpin shall well and truly pay or cause to be paid to the said William D. Smith or his assigns the said note with the interest thereon at its maturity, then this mortgage and obligation to be null and void; else to remain in full force and effect both in law and equity. In witness whereof, I have hereto set my hand and scroll by way of seal this first day of April 1845. In presence of (Test.) William Armstrong, Isaiah Junker. Malcom S. McAlpin {Seal}. Personally appeared befor the undersigned authority Malcom S. McAlpin and signed, sealed and delivered the foregoing mortgage in my presence and acknowledged the same to be his voluntary act and deed for the purposes therein expressed. {Seal} Given under my hand and scroll for want of a seal of office this 1st day of April 1845.
