The State of Mississippi Lauderdale County
Circuit Court February Term 1858
The Grand Jurors for the State of Mississippi, selected, summonded, empanelled, sworn and charged to inquire for the State of Mississippi, and for the body of the County of Lauderdale, upon their oath present that Franklin Eades, on the eighth sixth day of February, in the year of our Lord One Thousand, Eight hundred and fifty Eight, in the County of Lauderdale, aforesaid, feloniously, wilfully, unlawfully, and maliciously did make an assault, in and upon one Thomas J. Eason, and that he the said Franklin Eades, a certain pistol, then and there loaded and charged with gunpowder and one leaden ball, which pistol he the said Franklin Eads then and there in his right hand, had and held, to, at against and upon him the said Thomas J. Eason, feloniously, wilfully, unlawfully and of the malice aforethought of him the said FranklinEads, did shoot and discharge, with intent of him the said Franklin Eads, feloniously, wilfully, unlawfully, and of the malice aforethought of him the said Franklin Eads, him the said Thomas J. Eason, then and there and thereby to kill and murder.
And the Jurors aforesaid, upon their oath aforesaid do further present, that Thomas Eads on the day and year aforesaid, in the County aforesaid, feloniously, wilfully, unlawfully and of his malice aforethought, was present aiding, abetting and assisting the said Franklin Eads the felony and shooting with intent to murder aforesaid to do and commit; against the peace and Dignity of the State of Mississippi. In testimony that the foregoing writing contains a true and perfect copy and exemplification of a certain bill of indict ment of like tenor & purport on file in my office, found and returned into court at the February Term 1858 of the Lau=derdale Circuit Court, by the Grand Jury of said County, at the said term and that the said Defendants have fled beyond the Jurisdiction of the State of Mississippi.
I Charles W. Henderson Clark of the Circuit Court held in & for the County of Lauderdale have hereunto set my hand and affixed my seal of office the 10th day of February 1858
