On this point, I have only to add, that you will direct & control all
shipments intended to fulfill any contract made by you, & that, beyond them, you will ship the Salt,
directly, to Genl Green, at Mobile, or up the Tombigbee-river, as he may direct; and forward
the supplies by every boat, if practicable, so that they may be distributed in the interior, and among the
remote counties, as fast as possible. You will report, weekly, to this office, and shipments, or deliveries
made, by you, from the State-Works.

By the provisions of Act No 2, the terms of the lease of the Lower Salt-reservation of the State, to J. P. Figh,
have been radically changed. He has filed his writen assent there to, and given bond, as directed
in the act, and, under the directions, contained in the 2d Section of the act, you are, hereby,
authorized, as my agent, "to lay-off, & set-apart, to the exclusive use & control of John P. Figh, so much of the
lands included in his lease, as will secure him against any interference or hindrance, in the
enjoyment to his lease, or in the procurement of water, adequate to the supply of any number of
any number of boiling furnaces, machinery, & other fixtures, necessary to the full enjoyment
of his lease. He is, also, entitled, under this Act, to the exclusive right to all the wood
upon the two Sections embracing the lower reservation.

Under this new Contract, Mr Figh is to deliver to the State, two fifths of all the Salt made
by him, and divisions of the Salt shall be made as often as required by the Governor, and this
Contract commended on the 11th day of this month, when he accepted the new Terms
proposed in the Act. The divisions - receipt - & shipment of this Salt, on a/c of the State,
will require an agent for the State, resident at the works of Mr Figh. Until I can procure
a suitable man, to take the position I have to request that you will make the needful provision
in the premises. The divisions of the Salt, I wish made, at least, twice-a-week, so that the State's
proportion. The accounts of these divisions & shipments must be kept separate & distinct from
your operations on the Upper Reservation; & repoerted, weekly, to this office. Both acts,
No 1 & 2, authorize the rent or lease of all the surplus water, which may be found on
each reservation. The lessees, however, will be required to furnish their own wood, and
it must be obtained from other lands, than the State-reservation; all the wood upon the upper
reservation, having been reserved, by the acts, exclusively, for the State-works, & upon the
lower reservation, for the Works of John P. Figh.

You will lease the use of all surplus water for one tenth of the Salt manufactured, the
divisions & deliveries of the Same, to be had at least twice a week. The
deliveries, at each reservation, must be kept, and reported, weekly, at this office. You are, also, hereby,
authorized, as my proxy, to locate all persons engaged in the manfuacture of Salt on the public lands,
or who may lease the privilege of manufacturing Salt, and set-apart, to each manufacturer, or
Company, suitable grounds, by metes & bounds, in such manner as to secure the State-works
& the works of John P. Figh, from hindrance or inconvenience in the prosecution of their
manufacture, & to prevent collision between those who may be engaged in the manufacture, for their
own use. And you will observe, by the last proviso, in Section 3, of act, No 2, that no person
is, thereafter, to manufacture Salt upon the public lands, without making a Contract of lease. You
will take immediate steps to advise the Public, accordingly, & to lease the surplus waters, so
that the manufacture of Salt may be increased as rapidly as possible. As there are,
perhaps, persons now located on the Reservations, and who had erected their improvments before
the Act passed, it will be just to them, & the State, to allow them to continue their operations,
on their entering into Contract of lease, as required by the law; provided, they yield to such
alterations or change of locality, if necessary, which you may determine to be proper &
requisite to carry-out the purposes of the law.

I will not anticipate that any citizen of the State can so far forget his duty, as to
oppose, or resist any action you may take, in executing the law; but, to provide against
any such contingency, I enclose you herein, authority to use the military power, if it
should be necessary to reesort to its use, in order to enforce the law, and maintain the
authority of the State.

It may become necessary to erect a Store-room, at the lower reservation, for the storage
of Sacks & Salt, delivered to the State; & if so, you will have it constructed. And, with
the copies of the Acts before you, under the appoinment you hold, as the "Salt-
Commmissoner, for Alabama," & under the delegation of authority herein
