This case being brought up
on writ of Error from the
County Court for Talladega
County and upon the transcript
of said
cause from the records of said court filed in this
court. The parties appeared by their counsel and
the matters and things therein assigned for error
having been fully heard by the court. It is considered
and adjudged that the judgment entered in said
cause in the said County court for Talladega County
be, and the same is hereby reversed and in
all things held for nought and that said cause
be remanded to said county court for further proceedings
to be had thereon. It is further considered
by the court that the costs which have accrued in
this court be paid by the defendant in error for
which let execution issue. To all of which
action of the court the Deft. in error excepts.
