time of its collection from Nabours = which charge
the court gave and the said defendant excepted. -
And the defendants counsel asked the court
to give the following charges.
1 If English furnished the money which the
Plff. paid to Knox as the agent of the Plff- the
Plff has no right to recover.
1 If the complt considering his liability on the
Bond doubtful paid seven hundred dollars as a compromise
to Knox the agent of the defendant upon
an agreement, that the said $700. should
be a satisfaction of the whole demand and if
the Jury further find that Camp agreeable to the
compromise and entered satisfaction of record
of his entire demand against said English
then said compromise has the Plaintiff right
to recover -
3 If the Jury believe from the evidence that
the Bond on account of which the payment was
made, was signed by the Plff. and in consideration
of said Bond being given to the Sheriff of St Claire
County delivered up said slaves to the said English
and the said Plff paid $700 to defendant in
discharge of said Bond then notwithstanding the
Bond may have been quashed as a Statuary Bond
yet it is good as a common law bond and creates
a sufficient obligation to sustain the payment & in
this event, the Plff cannot recover.
4 If the Jury believe that the money which
the Plff. (Nabours) paid, viz. the $700 was justly
due from him to the said deft then the mere
quashal of the Bond does not authorize it to be
