& co. on the same day in the same court
also recovered judgement against the
same defendent for twentty four hundred
and thirty three 02/100 Dollars.
And whereas the said plaintiff claims
that the west half of lot No. 1 in Block B.
fronting on Broad Street twenty six
and three inches, and running back two
hundred and ten feet to an alley in the
city ofEufaula Alabama, is subject to
said judgements as the property of said
defendent, and whereas Martha R. W.
wife of said defendent, claims that said
lot was purchased by said defendent with
means belonging to her as part of her seperate
estate and that in equity a resulting trust
in said lot would be established in her favor
and the same decree not to be subject to
dependents. Now for the purpose of avoid-
ing expense, delay and hazards of litigation
te party of the 2nd part proposes and
agrees to pay the parties of the first part
the sum of three thousand Dollars in
ther following installments. viz- one
thousand Dollars on the first day of
November 1867, one thousand Dollars
